Now they're going after IM spammers. Of course his attempted extortion made him first in line.

If they are using their own servers and resources and have true opt out ... I would tend to agree with you.

However knowing first hand what it costs companies to combat spam in the way of anti spam software, usage of bandwidth, space and what not it always turns into theft of services rather than spam and therefore thats where the jail times come in.

Also these spammers gets ip blocks completely blocked by these off the wall spamhauses then the hosting companies are forced to setup new ventures to get "clean ips". Spam costs all us in this industry money like it or not.

Think bandwidth is free? or space on a server? then why is your host charging you every month.

I hear ya, but spam does cost millions. But this was no usual spammer either. If the accusations are true, he was threatening myspace for a contract or else he would let the dogs at their system, and that can't be tolerated. That's extortion and does deserve jail time.
