Thinking of suing someone? Think again, New federal law.

Class Action Fairness Law signed today.

ANY amount over $10,000 must be handled by a federal court.

90 Day waiting period meaning you sue someone, they have 90 days to prepare their case.

You MUST sue the person in THEIR own domain (IE: their home town, county, state)

Trial Lawyers do not get high fees anymore, the JUDGE tells them what they may charge per CASE.

JUDGES decide the actual amount of the award and they are allowed to throw out anything.

Bush gave an example, a lady sued a grocery store over a coupon for $0.50.
The judge awarded her $0.50 because that's all it was worth.

So someone steals an image set from you, the judge looks at the pictures and if THAT judge thinks the pictures are only worth $50.00 thats what your getting.

Read about it on Cnn.

That kind of sucks, but like everything I suppose it's got it's pros and it's got it's cons.

tony286 02-18-2005 10:43 PM

very fucked up

Vlad 02-18-2005 10:45 PM

what the hell
they are making it easier for scammers/frauders :(

Spunky 02-18-2005 10:46 PM

Makes sense on not wasting valuable court resources on frivilous claims

MGibson 02-18-2005 10:47 PM

It was actually good untill Bush added all kinds of crap to it, it looks nothing like it did when he first got it.

MrIzzz 02-18-2005 10:51 PM

interesting....

i cant make up my mind if its a good thing or bad yet

Wrong.

Federal Copyright Law specifically awards a MINIMUM of $750.00 per image per occurance of the violation.

If you are going to use an example....Perhaps you should have some knowledge of the laws that govern the example.

MGibson 02-18-2005 10:53 PM

Heh, someone violates federal copyright law, you SUE them.

This law takes precedence.

Considering CNN just aired Bush signing it into law and READING it word for word, I'd say thats pretty good qualifications Mr. Arron M Esquire.

good news for "documentary" content producers :winkwink:

FIX01 02-18-2005 11:04 PM

Insurance companies have been pushing this for a while claiming this is the reason for such high premiums. Does anyone actually think prices will go down on insurance rates?

I'll tell ya what sport.....How about if you get your facts straight...THEN come back and apologize?

A copyright case is an open and shut case under most circumstances. Most of the time they never even go to trial. Copyright laws have a set minimum penalty in place and a Judge MAY award more if he sees fit.

The type of law suits that this new law covers are typically not ones that already have a Federal penalty in place.

I'm not saying you are wrong about the law....I am saying you are wrong about the copyright example you posted.

I copyright images on a monthly basis. Where does your knowledge come from?

The law covers multi state class action lawsuits and moves them into Federal Court...which is where they should have been in the first place.

MGibson 02-18-2005 11:16 PM

The new law that was just signed into affect, regarding ALL lawsuits over $10,000

Exactly. And since only one person or company can own the copyright to any given image, there is no way to file a class action lawsuit.

For those who do not understand the difference....A class action suit is where MULTIPLE parties file suit against the same defendant for the same reason. (This is a basic example....Not textbook.)

Go ahead and violate my copyright 20 times or so and we can test your theory.

Interesting. Initially you stated...."Class Action Fairness Law" but know you are saying "ALL lawsuits."

Clearly you have no idea WTF the difference is.

Go back to school.

Quote:

Under the legislation, class-action suits seeking $5 million or more would be heard in state court only if the primary defendant and more than one-third of the plaintiffs are from the same state. But if fewer than one-third of the plaintiffs are from the same state as the primary defendant, and more than $5 million is at stake, the case would go to federal court.
