If you catch him the time he commits a crime it seems acceptable by the law. If you try to play the policeman it's different. If you harm him he can ask your prosecution.

Interesting. So basically, if you see someone do something illegal you can say "Hey, you just committed a crime, wait here while I call the police on you."?

Any constable or other person may without warrant apprehend:

a) any person in the act of, or immediately after having committed an offence punishable under any Act.

b) any person who has commited a serious indictable offence for which the person has not been tried.

And take that person, and any possessions found on that person, before an authorised justice to be dealt with according to the law.

Crimes Act 1900

Of course this only applies to NSW Australia :P

I am not planning on making a citizens arrest or anything like that, but I remember it from Police Academy and just saw it on Reno 911, so I wasn't sure if it was something someone could really do or just a comedy movie situation.

BTW, what I said in this thread is from my memory, but it is very close to the law across the whole of Australia regarding citizens arrest, and it the only legisilation that truly affects both citizen and police powers of arrest (section 2, 3, 4 deal with police powers exclusively). And I'd assume that it would be VERY similar across 90% of the western world.

Imagine a show like COPS, but instead of actual police officers, it would have regular guys that drive around with a police scanner trying to arrest people.

That could be funny. Especially if the "regular guys" are real idiots that have no respect for the law, they just want to act tough.

I arrested 4 punks that were doing hit and runs smashing cars on Wilshire Blvd in BH. They came right at my car heading in the wrong lane and almost nailed me.

I did a 180 and went after them. I was doing a lot of Police K-9 training at the time and had my car decked out with equipment. So I lit them up, went on the loudspeaker and had my Shepherd in the back seat do his attack bark over the speaker so they would know I had a K-9 dog in the car and wouldn't run.

They pulled over. I ordered them out of the car and down on the curb with their hands interlocked and had about 6 patrol cars converge in within minutes.

It was a big risk with 4 of them in the car, but with a police dog and a shotgun I figured the odds were on my side.

i think you're supposed to have a cop with you and you just say "this is a citizen's arrest" and the cop does the actual arresting.

if im correct there is this new law in holland where u may check if a cop is breaking the law and report it or something, there was this commercial where some dude gave the cops an alcohol test..... but i dont know if u can citizin arrest them, that would be very fucking funny haha

What is the point of making a citizens arrest if there's a cop standing right there who is going to do all the actual arresting anyway?

Actually citizens arrest is LEGAL in all 50 states.

I don't care if it's florida or not.
It's otherwise known as Bail Enforcement, Bounty Hunter.

They carry no licenses needed, just a surety bond from a Bail Officer.

They don't need search warrants.

In FACT in Florida, there is a town that has implemented VOLUNTEER citizen police officers, they don't carry a gun, they DO drive police cars, they CAN arrest you (Citizens arrest)

It was talked about on Cnn tonight because of the pros and cons.


So as far as no citizens arrest in Florida, you must be high.

You can hold and detain people untill the police arrive. It's seen on Cops all the time. Guy tries to rob a store, store clerk smacks him with a bat and sits on him and yells "call the cops"

It's a wonder since your not a police officer they didn't arrest you for Brandishing a Firearm, illegal in Florida.

While it's not illegal to carry a shotgun in any state in a car as long as it is not hidden, and you are allowed to, it's not legal to throw down on someone.

I've seen that move hundreds of times.. maybe i should get a camcorder and clean out the police dept. Just 2 fucking days ago a cop lit his lights up just to get past a few cars, shut the fucking thing off as soon as he got by, he didnt have to deal with traffic, i got to shit myself.

I didn't brandish it. LOL. Didn't need to. The dog did all the work for me.

A couple years ago I was turning right of my street. I stopped at the stop sign and adjusted my seatbelt, then was starting to make my turn when a cop flew by at 60 MPH (opposite lane, going left in front me, residential street). It scared the crap out of me and I stopped barely into my turn and my car shook as he past. I finished my turn and the by the time I had headed 1 block to the next intersection where I was turning left, he swung around, gunned it through the 2 blocks he had me passed initially and the extra block and was behind me before I had time to turn.

Even though there was a garage and shrubbery that would have kept him from even seeing the stop sign coming from that direction, the asshole made me pay twice as much as the fine for running a stop sign by classifying the ticket as "disregard of a traffic device".

A lady on the corner who witnessed it said that either he or some other cop would fly past her house at that speed almost daily. Unfortunately she was too scared to even give me a written statement. I guess they will get away with it until they kill one of the neighborhood kids. I just hope if something tragic like that happens there will be a witness and they won't be afraid to come forward:( Probably won't matter. I tried to explain to the traffic judge what happened and he laughed at me and ridiculed me. His cops are angels, you know.
