"Raising the case to the 3rd Circuit Court of Appeals might be a risky venture for the government, according to legal experts, because the court has traditionally been favorable to Internet free speech rights.

Twice, the appellate court ruled that the Child Online Protect Act was unconstitutional, fire finding that its use of ?community standards to judge Internet content would ?subject Internet providers in even the most tolerant communities to the decency standards of the most puritanical,? and then finding that the law was too broad to avoid infringing on free speech rights.
excellent.

There are probably enough activist right wing judges around to overturn it. Let's see if the Bush White House pulls strings behind the scenes to screw over Americans right to do what they want in their own homes again.

Bush has been packing the courts with activist right wing policitical judges as fast as he can.

Bush has no interest in protecting the Constitution, and every interest in trying to force his right wing bullshit on all Americans, even in the privacy of their own homes.

Look what he's been doing in California with the medical drug laws.

Republicans claim to be for less government? :1orglaugh :1orglaugh :1orglaugh

Well, I guess this means we (meaning the adult community) get some kind of legal precedent out of this. On the down side, I bet it means a ton more in legal fees for Rob Black.

This is all bullshit, you wait, anytime now we'll be hearing about a military draft because Iraq has turned into a finishing school for terrorism and Iran and North Korea will be our next targets on the Bush Jr. GWOT world tour. :(
