Police said they were charging Garcia with first-degree assault, reckless endangerment and criminal possession of a weapon. He was not immediately available for comment.

Juan Rodriguez, the owner and operator of the Hunts Point franchise, said in a statement that the restaurant was cooperating with authorities.

"The safety of my customers and my crew is top priority and I take this matter very seriously," he said.

I cant remeber where i saw a video recently of a cop who went thru a mcdonalds drive-thru and he gives the girl a $10 bill , then when she gave him his change the cop was like " i gave you a $20 bill " and she was like umm i dont even have any $20 bills in my drawer , so he says , then you must have stolen it, and he comes inside and orders her to empty her pockets, and she refused, then i think he pepper sprayed her and arrested her. But it turns out the whole thing was caught on video and the cop was wrong..

That happened here in Dayton, couple years ago. He was cleared of any wrong-doing. The tape the media got was not the whole tape, there was much much more you didn't see leading up to the resulting arrest. The media only played the juciy part, and did not include all of the audio. You can look it up in the Dayton Daily News or whiotv.com.

I have no problem with cops at all, but it just pisses me off when they use their power to fuck around with people like this.

No they did mention the cop was aquitted , but the girl won a civil suit against the police department. And i'm pretty sure i saw the entire transaction ( i could be wrong though ).

Besides the cop was an idiot anyways , the girl kept saying she wanted her mother to be present when it happened and the cop tried to go into her pockets.

1. Yes, the cop was/is an idiot, and yes, I do know him.
2. Yes, you did see the entire transaction, but not the entire tape. And there is aproximately 3 minutes of audio removed prior to the transaction that would further explain why the officer reacted as he did.
3. Yes the officer was aquitted, and yes the girl's family won a civil settlement, but the settlement terms were not based on the actions of the officer, they were based on the emotional response and possible long-term emotional effects, which is how most of them go anyway.
4. Either way, it was a bad day for everyone involved.

so can you tell me what went on during the audio that changed his $10 bill into a $20 ? or is it something else.. the audio after i heard and she was talking shit i agree. she was like "im gonna tell that cop he is a moron or somthing " after he argued then parked and came in.But she is a minor and it should have been very simple conduct for an on duty officer. He would call for backup THEN arrest her or search her etc , but not grab her and mace her because she refused to get searched without her parents there . Thats a reasonable request.

I really shouldn't comment on what happened and whether he was right or wrong during that incident, it's just not my place, and a lot of people would not understand not being in that line of work. I was and still am close to many if not most of the officers on that Department. I worked very very closely on many things with them, and overall they are a good Department.

However, what I will say, in his defense, and this has to do with the audio you have not heard, is that she threatened him and other police officers (and by threatened I mean a threat of aggravated/felonious assault) before he pulled to the window. Now, in her defense, he acted improperly based on the notions he had set forth in his mind because of what she said through the mic that she did not realize was still on and broadcasting to the speakers outside.

He did not mace her for her refusal of a search, he arrested her for resisting arrest. That's why he was eventualy acquited. And in Ohio, as a minor, you are not entitled to have your parents present during a search, only during an interview or interrogation.

I'm not saying he was wrong, I'm saying in my opinion he acted improperly. He should not have investigated a crime that he was a party to. He should have served as a witness and had his Seargent or Lt. come out and deal with the local and initial investigation.

Also, to the best of my memory, and don't hold me to this yet, I will have to ask again, it was a $20.00 bill, and it was found. That part I think got lost in the story because of all the other more serious issues.

Cops fuck up. I have seen it a hundred times. Shit that just isn't right. And along the same lines, other cops see shit and keep there mouths shut. It's not right. There was another case last year that involved another guy I knew. Great guy, and a great officer. He was the primary car in a pursuit involving a bank robbery suspect. When the suspect wrecked out Andy was the first one on him and he straight up cold cocked him in the head with his gun. I mean he fuckin rained down on this guy, and all right in front of his cruiser with the camera rolling. There was no question what he did was wrong the way he did it. No question at all. He was fired and, but sued the City and went to arbitration and eventually got his job back.

Now that's total bullshit, but it happens. Cops aren't perfect, but each night, when we say we only fight to go home, we eventually have to face reality and make peace with what we've done. Karma is a motherfucker, and it WILL eventually catch up to you. Andy got his a couple of months ago. It was a total accident, but he is no longer employed by the city, let's just say that...

Well you obviously know the story better than i do , and like i said , even during the filmed part she was talking shit about the cop, but i would have done the same thing if the cop lied about giving me a $20..

Im pretty sure i saw the thing on REALTV so they arent exactly facts but , im pretty sure it was clear case , the cop drove up and gave her a bill she placed it in her register and then he said it was a $20 and both her and the other clerk checked the drawer and there was no $20 in the drawer, so unless she slipped the $20 in her pocket and a $10 bill in the drawer then he must have made a mistake.

Its kind of hard to take what she said before he drove up as a threat since she didnt know the microphone was on. And it just seems so obvious if i knew that part that the guy was pissed off that she made remarks about him and just arrested her because he could.Nobody is going to try and intentionally stiff a cop, expecially like that knowing your on camera.. i just dont buy it..

I do agree though that , any cop would know not to do anything without FIRST calling backup.

When i was younger i had an offduty cop smash his car into a parked car with his pregnant wife in the car while he was trying to lean out the drivers window and grab me off of a bike i was riding.

It turned out the bike was stolen a week earlier from this cops backyard, and the bike indeed turned out to be his, but i had just purchased the bike from a local bike shop and had the receipt in my pocket at the time.

It kind of reminded me of that guy.
