Please opine if you are familiar with the alleged offender and the offense.

Also, feel free to offer any verifiable material facts that you feel should figure into the decision.

I'm not familiar with this case, but if you had to shut down an affiliate everytime someone claims to have been scammed by them and it isn't linked to their promotion of your program you'd have a fulltime job. If he doesn't break your rules I don't see why you should kick him out.

Again I have no idea what this person/company did but they did nothing to AFF and as long as they promote them in accordance with TOS I can't see why AFF would cut them off

Theres no way AFF should even consider banning adstats or else be consistent and prosecute all the illegal 404 people as well. Adstats is doing nothing that violates the terms and no-one has to use adstats either.

Its none of AFFs business what adstats does to acquire traffic to that
program if they not violating terms of business. If people dont like what adstats is doing, they should just let people know and/or stay off the program.

Adstats billed $15mil in excess in a timeframe of 90-100 days without paying anyone besides the first wire or so. Props to them for screwing the majority of webmasters and still having people to support them for fairplay.

People, take a step back for a minute and remember there is no connection between adstats and AFF.

Do affiliate programs conduct background/criminal/credit checks on you when you sign up as an affiliate? I would assume generally no.

I am sure I could sign up as Osama bin laden or Charles Manson and be instantly approved by most programs.

So, AFF didn't know anything about the individual who signed up to promote AFF on Adstats sites. It probably wasn't even Jon Silverton or whatever the Aussie fisherman scammer's name is.

Apparently the guy has not broken AFF TOS otherwise he would be "cut off" rather quickly as Jack graphically pointed out to us recently.

So now that AFF knows one of their affiliates has ripped off people in the past, do they have a legal/moral/ethical obligation to can him?

I don't think they do as he has not broken AFF TOS. It is too much of a risky gray area to get into and I think it is better they remain neutral. Otherwise webmasters will be requesting affiliate programs to terminate any other webmaster they don't like for any reason whatsoever.

I would also assume an affiliate program is legally bound not to divulge personal information unless subpoened.

So all you guys that didn't get paid, why haven't you got together before now,.. wasn't it like a year ago? .. and gone after Adstats instead of somehow now holding AFF responsible and threatening to stop your traffic to AFF or some other immature reaction. Australia is not Afghanistan, they do have a legal system there last time I looked.

I can guarantee many of you know other webmasters who don't play by the books, yet you still promote the same sponsors as them so please drop the holier than thou attitude. You took an obvious risk when promoting Adstats, some got paid nicely, some got burned bad, thems the breaks.

Don't get me wrong, it sucks that they owe tons of money BUT isn't that the risk most of you took KNOWING that it could go away in the blink of an eye?

C'mon - you had to see it coming!

Most did, but you couldn't really do much by that point!

I really feel bad for everyone that lost money or had money owed ... and I know and it really SUCKS BALLS for the people that got in at the tail end ... but for the people that got in early ... when the timing was ripe - let's be real for a sec ... you enjoyed the ride while it lasted - didn't you?

as for adstats....

well i got in late and got zero from them, so i assume some of my money went to pay the people that got in early.. it looks like i will have to revisit what sponsors we deal with, in regards to the people that are currently supporting adstats...
