Wtf ?? Isn't this illegal ???
 

Today I received a spam mail with a site that contains nude pics of 12-16 year old girls. I contacted the webmaster and he says it are "art pictures" which is perfectly legal according to him. Can anyone confirm this is true ??? If not, i'll take further actions.

I'm not sure about the legalities of it. However, I think if it has anything questionable you may as well report it to http://www.asacp.org/ .

it depends on the type of pictures if it is nude with out focusing on the genitals (close up shot or just the genitals) then unfortunatly they may be legal assuming that when the pictures were taken they the photographer had perental permission. But what the hell report it anyway then if they are not legal the site and site owner will be taken care of. Most states have laws that cover people who report possible child abuse and such making them not liable if they are mistaken. Keep in mind it is a crime not to report it if you belive it is illegal just as much as it is a crime to do it

While it behooves anyone in the porn industry to stay away from ANY pictures of nude children (or even clothed ones, for that matter), mere nudity of a child is not illegal, because it is not obscene. For it to be obscene, there has to be lascivious display of genitals, sexual contact with another person (child or adult) or some other "sexualization" of the image. I myself don't want people to go to jail for taking pictures of little Rollo standing next to the bathing pool in his birthday suit, although this kind of absurdity goes on fairly regularly in that otherwise liberal state, California.

Actually (for sure in Canada and probably in the USA), it is not a CRIME to not report a crime being committed. What's illegal is aiding someone in committing the crime.

From non legal point of view, you should report it and let them do the investigation.
