Question About Celebs v. Copyrights
 

Ok, this is where it get's confusing.

Someone was telling me, or I read somewhere, that you can't copyright a photo of a celebrity that you took, because the celeb is already a trademark itself.

So, if you can imagine, I've been through 250 AVN and xBiz pages, looking for celebrity copyright info.

And where it gets REALLY confusing, is when people have celeb galleries. Because 1) Half the pics are scanned from Maxim or Victorias Secret, 2) How the hell can you sell a trademark that's not yours?

I don't have the slightest idea!

It's a grey area that is rarely inforced but if you do like Mr.Skin and review the material you can get away with it because it's part of the fair use act.

I don't know Mr.Skin. And what do you mean by "review"?

If that's true, what stops people from using Jenna Jameson's pics? I think she qualifies for "celebrity status". I mean, she did fuck Marilyn Mason...
