Madonna sues Dr. Dre, Mary J. Blige, and Eve
 
Legendary pop singer Madonna is reportedly suing R&B songstress Mary J. Blige, Aftermath producer Dr. Dre and rapper Eve for copyright infringement.

A publishing company claims that Blige's recent song "Not Today," featuring Eve and produced by Dre, too closely resembles Madonna's classic 1983 hit "Holiday."

According to court documents, the company alleges that parts of "Not Today," which was featured in the film "Barbershop 2" starring Eve and Ice Cube, includes several obvious instances of reproduction.

New York musicologist Judith Finell, an expert witness on copyright infringement, compared the two songs and concluded that "Not Today" is similar enough to
"Holiday" and warrants further investigation.

"Both the pitches and the rhythms sound closely related," Finell told the Associated Press. "I don't think they're identical, because Madonna's song is in what we call 'major key' and Mary J Blige's song is in a ?minor key.?"

The publishers of Madonna's song could receive at least $15 million if the case goes to trial and jurors determine that "Not Today" sounds notably similar to "Holiday."

I think it's stupid that Madonna gives a shit...but at the same time people should make original music and stop copying people's older works. :2 cents:

Shes seeing the end of her 20 plus year ride come to an end and now shes bitter. Thats pretty sad if you ask me.

They are not suing because all of those are licensed out.... have you ever bothered to look inside the sleeve of a CD? Royalties....thats how most of the older artists are still making a living.

Snares are sampled out and paid for.

I had never heard either of these songs before. I just downloaded them. There is a brief portion of the "Not Today" chorus that sounds similar to the way Madonna sings the chorus word "Holiday" in her song "Holiday". Quite frankly not enough to be considered problematic IMO. The songs don't sound anything alike.

Both songs are terrible btw.

On a similar note, Dre has been sued at least twice before for using a sample without giving credit to the persons he sampled from. He was sued by some Jazz musician for a sample used in an Eminem song and by an East Indian singer in India who's sample he used on the song he did with Rakim. He didn't get permission from those parties and obviously no royalties so they rightfully sued.

Look, as BB. King told me some years ago, "All the greats do when they make hits is just take a riff from another song that they love, build on it then add their own flavor to it."

Sampling is not new and it's not limited to hip hop. This Mary J. song isn't a rip of Madonna's song. Madonna will lose this one quickly in any court of law.

Gotta admit that there is alot of bitting in the urban scene right now as far as beats go. Kinda sick of hearing totally noticable samples as the main hooks in some tracks these days. I love hip hop but not the mainstream shit!

I know what you mean. It's one of the reasons I don't listen much anymore. Sampling is fine if you make it into something fresh (like Naughty By Nature's song OPP sampling of Micheal Jackson; a fresh twist sprinkled with bits of an old song in the background). But when the entire song is based around a familiar song we've all heard before, its boring.

I'm listening to it now. It sounds nothing like Holiday except when they say "Not today" it sounds like "Holiday", just 1 word. Everything else sounds completely different.
