please read the last line again, I did not trust him when we started negotiations so I wasn't counting on an ACTUAL deal anyway.

Of course I did not transfer the domains to him, why would anyone do that before receiving payment (or escrow notice)?

Do we have the domains? Did you transfer them to us? No. You didnt nore should you have without payment from us or anyone. Time got away from us and situations changed. It happens. If you had transfered the domains to us and we had not paid you...then we would have something to talk about. Wish it had worked out, but it didnt. Would have loved to use those domains, just no time to develop them right now. No one was ripped off here.... move along.
