Ryan Pitylak, a student at the University of Texas in Austin, and California resident Mark Trotter were named in the suits, which claim breaches of Washington spam law, Texas trade law, and the CAN-SPAM Act.

This outfit, according to The SpamHaus Project's Register of Known Spam Operations, ROKSO, is the fourth-largest spamming group, going by the names PerAction LLC, Leadplex LLC and Leadplex Inc, all Nevada companies.

Microsoft's suit claims the defendants failing to identify millions of messages as being spam, and that spoofed domains and misleading text was used, in violation of CAN-SPAM.

The alleged spammers were traced from e-mails caught by Hotmail and MSN spam traps, as well as through the work of Texas resident Dewey Coffman, chief executive of anti-spam vendor Net-Sieve Inc.

The Texas complaint claims that the defendants' spam attempted to gather leads for loans and mortgage companies.

CAN SPAM is such a joke. I get about 20 lbs of paper postal junk mail a week. And probably 100 million Americans get the same amount or more. I never asked for or wanted any of it, but that's ok because it's paid for, right? Unreal.

Unfortunately, that's how courts look at the matter. That's the reasoning behind court decisions allowing junk mail--the cost theory. With physical mail, the mailer assumes the heavy costs. With email, the costs are transferred to the receiving ISP and, in terms of time processing the mail, the recipient. Regardless, in both scenarios the receiver wastes time filtering.

I've always thought spam is more of a technical issue instead of a legal one.

In other countries people dont get postal spam, or at least not that much for sure.....

The truth of the matter is that if enough citizens complained loudly enough to lawmakers then postal mail spam would be eliminated. It doesnt get the attention email spam does beacuse it isnt quite as sleazy and is relatively minimal compared to 500 porn spam mails in your in box every day.

Yeah, it all comes down to money and who's not making any from what and what's costing who what. Junk postal mail costs people who receive it money and very few complain about that. I pay like $50/month for garbage removal, I'm sure it would be a lot less if there was less advertisement paper/brochure waste. Ok, yeah spam costs X, Y and Z money but it's just an outrage that high volume email deployers are classified as common criminals and would be burned at the stake by the masses if they could. Meanwhile, drunk drivers, rapists and other violent offenders get probation.

Antis suck, they go around legally terrorizing people for sport. Greedy, corporate America sucks. Not every spammer is a multi-millionaire, with elaborate international setups like the media sensationalizes these few stories we have heard as of lately. They want to make examples of people, and it's backfiring because people see the money that the media exaggerates and suddenly, everyone wants to spam. "yo, where can I get Dark Mailer?"

Where else but GFY and other spam support boards can we get a vile, bottom feeding, IM spamming skank and various other lowlifes who will instantly get on their knees for a buck explain to us how spam is good, Pitylak is just a misunderstood entrepreneur, and anti-spammers suck?

Can Spam essentially legalized SPAM in the US. All you need to do is follow the SIMPLE RULES and the Feds can't touch you. But spammers are lazy, greedy, totally devoid of ethics, generally stupid, and believe that "silly rules" don't apply to them. But listen to them whine when the Feds, or the State of Texas (yay!) in this case, FINALLY start enforcing the law.

Most internet users, ISPs and "ethical" Web hosts hate SPAM. It cost billions of dollars a year in wasted bandwidth, filtering, labor, and storage costs. Only corrupt and bottom feeding spammers, sponsors, and "Spam Support" outfits here on GFY think otherwise.

Do you have any idea how many millions of peolpe say exactly the same thing about anyone involved in adult?

And it's not about how good or bad spam is, it's all about having your priorities in order. Do you really think that your government should spend millions on fighting spam, when you have one of the highest crime rate in the world, when you have so many kids that can not afford more than one meal a day?

Or yea and last but not least, selling cigarettes is OK with you, it's perfectly legal, it doesn't cost a cent to your country, and nobody ever has died from a smoking related illness. One of the main reasons why the USA government decided to go after spammers - it doesn't get slice of the pie!!!!

This is what i think, they need to focus more on getting the rite technology (filters) rather going after people one by one. That will stop the spam.

If one goes down, another one will replace it in a heart beat. So spam still comes in.

If SPam through physical mail were regulated or halted to some degree the over all savings would reach the billions.

The Paper savings alone would be good for the envirnment.

infact if you added a link inside each email to waive the 10 cent fee if you know the user..

So it costs anyone 10 cents to email someone , but if the recepient knows the sender he clicks the waiver link and it waives the fee. So only unsolicited email gets charged the 10 cents :)

That only means that email will die as a communication tool. Not sure how it is in the States but here I can send an SMS form a website for free.... Which means that peolple will start SMSing instead of emailing each other. Next thing you'll stgart getting thousand of messages on your cellphone: "Cheap Rolex! Get yours now!" etc ;)
