I'm actually so woried about this email that I am going to read more than the first paragraph by tomorrow night, I am almost positive. I think. Actually I may just forward it to a few people and see what they say about it.
GFY is a sounding board for me, not a church. If I really thought this letter was serious, I would never ask anyone for advice besides my lawyer - however, my lawyer charges $50 just for me to call and ask if she's available, so I tend to make my own calls on most stuff. I do appreciate the "get a lawyer" replies though, it realy shows that some people on here care and would rather help someone out than look like they know what they are talking about. The main place i promote LL is through the cobrand, so I'm more interested in if LL has something to say about this (such as "Don't worry Wolfy, I got it handled!"). We shall see :D |

Possible it will get delivered by postal too. It takes more time than an email to arrive. Ignoring C&D sent by email is stupid since anyone can sue you without any warning and be assured you'll find it out by certified mail in that case.

I got C&D's in 97 when I was a newbie from playboy and victoria's secret cos I was clueless enough to get domain names with those keywords. And I did C&D'ed ie. transferred the domain names over to them. If it's only some stupid gallery, just remove them cos that'll be way more cheaper than to even see a lawyer unless you're quite definite you are not infringing on any copyr.

Oh well, I have the Streamray cobrand, no C&D letter via U.S. Mail or e-mail, something else to be on the lookout for...

If you received a C & D, you should talk to a lawyer, regardless of how it was delivered to you.
You should rarely take advice from the mental midgets who frequent GFY. And, FYI, the copyright holder has NO LEGAL OBLIGATION to even send you a C & D. Upon discovering infringement, they could simply sue you. Your first notice would not be a C & D, but rather a summons notifying you that you have been sued. C & D's are usually sent as a courtesy to 1. Stop the infringement and 2. Faciliatate a quick and inexpensive resolution. You should get a lawyer and let him/her advise you as to how to proceed. |
