I'm in Vegas now and I'm not going to get in a lengthy content debate. There are numerous threads on this topic and everyone that knows us knows that we do what we can to avoid things like this and always take it down or send traffic back when something gets noticed. This video will be taken down.

Umm, Rick, would it not be better to have your people contact the owners of watermarked videos BEFORE adding them to your site? I assume that someone reviews all videos to make sure you are not adding CP or snuff or whatever, so why not just take the step?

Remember, all content is copyright to SOMEONE.

I've always wondered how Rotton.com, Ogrish.com, etc get away with copying and posting (often editing/adding their logo too) other people's pictures/video *without written permisson* for economic gain; commercial use.

Is such copying/editing they do legal or that no one has legally challenged them yet?

It really bothers me to see tunsami pictures / video that's been edited and degraded with logos/branding of such sites like Ogrish.com on them...

Just read the thread again ... some of those services claim they just merely host user uploaded content.

With that said, the DMCA safe harbor provisions may *not* protect such sites *that brand content as being their own*, such Ogrish.com does; shown a pattern of knowingly hosting copyright content belonging to others in violation of copyright law.

So I guess in a nutshell, no one has really legally challenged such services yet ... ?

First, I apologize for responding to you on a public forum. You see, I think the right way to handle something like this with someone that you've had a relationship with for YEARS, with someone who has sent YOU tons of traffic for FREE, would be to handle it one on one. What's my ICQ? Perhaps you should check your ICQ logs. My ICQ logs have conversations between the two of us going back to early 2003.

Or perhaps you should look at my responses to all the emails we've bounced back and forth. ALL my contact information is in my sig. If the shoes were reversed I would have called you on the phone instead of freaking out on a board. I guess we just do business differently.

For me, I would have a little more RESPECT toward a company that had run several THOUSANDS of dollars worth of free Video Sponsorships for me! But again, I guess we just do business differently.

I personally wouldn't treat anyone who had gone out of their way to help me like you have. If I approached someone asking about buying traffic, then found out I couldn't afford it, and then that someone GAVE me traffic because they liked my site/content I DAMN sure wouldn't behave this way because I don't like to burn my bridges, ESPECIALLY with someone who has tried so hard to help me. I guess we just do business differently.

Now, to the issue at hand. Your own popularity is to blame. Tough problem to have. The video WAS submitted to us without your watermark. There is simply no way for us to tell where all the content that gets submitted to us comes from. I agree that it's unlikely any of our fans would download your clip, remove the watermark, and then submit it to us. BUT, just for shits and giggles, lets look at another possibility. Maybe, just maybe, some OTHER website that's less scrupulous than us ganked your content and removed the watermark. Then perhaps one of their fans saw the content and downloaded it and submitted it. This doesn't sound so far-fetched to me.
