Well this is all a lot of hot air I think... Because you can't make a popup window illegal -- because you can't base a law on MSIE HAHAH!!! Those FTC idiots got all those popups because they were using MSIE or Netscape w/ javascript enabled...

That's like buying a gun, shooting yourself, and then trying to sue the company that made the fucking bullet.

I can see they would have a case against him if he opens a popup w/ sexual content that's inappropriate for children w/o a warning screen... especially for a mispelling of a cartoon site...

I know some lawsuits are frivolous, but in the Navegar case, it was clearly demonstrated in the 111 pages judgement that the semi-automatic weapons they were selling in the civilian market had no practical use whatsoever since it was a weapon made and designed for heavy combat situation requiring heavy fire power and maniability to aim at multiple targets.

The FTC can always come after you for deceptive trade practices.

Always stay away from kids stuff.

It makes a much better press release to say:
"and little johnny got redirected to a site with 500 popups and lost his article on dinosaurs after trying to visit the cartoon network."

Is much better than:
"Bob lost his spreadsheet after 500 popup windows came up after he misspelled cumsoakedwhores.com."

This is who they chose to come after the guy in spain the last time.

You will almost always lose deceptive trade stuff.

Teen sites - they can get you if the models are not teens. There is more than one way to skin a cat. Just don't be an idiot and go hog wild. The FTC has gone after people for selling stuff to help pass breathalizers. Not because it is illegal, but because they didn't work. They don't real ever seem to have much of an impact. their fines and stuff are almost always less than the person made.

$1,000,000 is a nice chunk of change, but the gov't always exagerrates those things.

And for the record - the woman who sued McDonalds was willing to settle for I believe less than 10K - she had third degree burns and McDonalds serves their coffee MUCH hotter than any other major resturant chain did at the time - AND THEY had like 400+ written complaints about it. Remember there are 12 people that hear the evidence in these cases - a lot of these companies are real sneaky bastards. People do not like frivolous law suits, but they also don't like shady companies - like automobile companies that pay garages $3,000 for TOTALED WORTHLESS automobiles in order "study the evidence".

Maybe so... but pretty much everyone on the planet knows that coffee is served hot, and especially someone at that age. Good info on the real mcdonalds case - mcdonalds own employee testified that they knew it would seriously burn people and was 45 degrees hotter than was safe.

If you really wanna sue them, drink the coffee while walking and then spit it out cause it was colder than you expected - and slip on it. That way you have a variety of actions.

Just trying to help.

Oh and I have been reading more about that guy - $800,000 - $1,000,000 was HIS figure given under oath in a previous deposition.

One of the main problem Chris is that people don't read the Judgement before they come up with their own made up mind about it!

Therefor they A) Have no clue what they are talking about, B) Don't know what the facts are in each specific case, C) They can't make a valuable argument because of A nd B.

Each case presented in front of a panel of judges is unique, people tend to fall into bias generalisation that server their own agenda!

But mcdonald's could probably come up woth millions of complains about the coffee beeing not hot enough/too cold. Exactly Wizdom - couldn't have said it better myself. There are two sides to every story - and if 12 (or 6) people do something that suprises you - you should read the facts to see why - usually there is an answer.

Freako, if you read the link I posted - you will see their own employee admited it was dangerous and there was actually 700 complaints of actual burns - including 3rd degree burns as they serve their coffee 45 degrees hotter than what coffee is considered safe AND that they KNEW it would cause serious burns in seconds. You should not have to worry about coffee scalding you. They serve it at the drive-thru, what did they think was going to happen?

According to that it takes 5 seconds in order for you to get a serious burn - at 156 degrees only 1 second. Just Imagine 185 degrees. If it had been at a reasonable temperature - most people would have enough time to cool off, but at that temperature - instant scalding is unavoidable.

I think the biggest complaint in the "mousetrapping" case is that his typoes were of common and often kid-friendly domains. Really, who wants a 10 year old kid looking for Pokemon shit on their porn site...that kid'snot even going to have a credit card...and webmasters wonder why per click programs have to shave to pay legit coin for shit traffic...

As for the McDonald's case, I too was skeptical until I read the case overview...it is easy to make uninformed opinions, hence the jury system...I was working in the resteraunt biz at the time of the suit and it actually had quite an impact on our resteraunt...
