I say if you're going to bare yourself to the public, then be prepared to be bared for the public. A good many states have laws that say anyone taking photos for commercial use, legally have to have releases signed from anyone in them. We signed them on South Padre for some guys shooting for travel brochures. No, in that scenario the porn company would be implying things about this person that aren't there, thus the argument of slander could be brought into it. In the case of Florida girl, nothing is being said about her, nothing untrue is being implied about her, the video is simply showing what she did (flash her tits to the world) and there's nothing legally wrong with that.

Is it wrong for her to flash her tits in public? Her dad or mom might think so. Is it wrong for an onlooker to see it and take pics or video footage of her doing it? Maybe morally, but legally no. Why? Because if she flashes her tits in the privacy of her own home and get's filmed, then she can argue invasion of privacy. But out on a busy crowded street at a huge media event privacy is neither given nor expected.

I'd be surprised if she wins this case, yet not. It would be typical of society to make an exception for her, but they may also make an example of her. Time will tell.
