it could simply be a template that both parties used - the only real copying I see is the banner header and nav buttons - though they too are standard buttons that you may find on many sites along with the graphics banner.

who knows maybe both stole the design or simply shopped at Walmart to buy "Website Design 4 Dummies" - either way, both designers arent that great

If the menu and template originally came from one of those sources, then it's really your own fault (or your designers) for not creating a design that you hold the copyright on.
