SALINAS, Calif. (AP) -- A Salinas man will have to choose between going to jail or joining the military as his punishment for possession of marijuana.

A judge surprised both the prosecution and defense yesterday when he told Brian Barr that he could avoid a jail term by enlisting in the military.

The 24-year-old Barr was charged with marijuana possession after shooting a would-be robber who had entered his apartment with two others.

Police say Barr sold marijuana from his home, and that the three men were searching for money and marijuana.

In giving Barr a choice of sentence, Monterey County Judge Robert Moody said that the shooting was justified.

Barr is scheduled to return to court next month.

For Marijuana, I'd pick jail. I would rather spend six months in the county. Bootcamp and training would last longer than that.

Well...the Judge would have to agree to dismiss charges against him...and providing he does not have any other convictions...and depending upon his education level...the military may take him...other wise his chances for being acceptable for the military are very slim to none.

Joining the military is not instant death, he could hedge his bets and join the Navy, or the Air Force.

Well considering you really dont need a high school diploma do join the military, I'm not sure how he could NOT be qualified. Some guys I know joined while still in high school.

Cosidering he'd do what 6 months to a year in jail and at least 3 years in the military and then then they can call you back into active duty up to 8 years later? I'd pick jail.
