Scott Peterson: 1st Degree Murder or 2nd Degree Murder? You Decide.
First Degree Murder: In order for someone to be found guilty of first degree murder, the person killed the other person with malice or the killing was premeditated. Premiditated means, killing someone intentionally or was planned. With a sentence of death penalty or life imprisonment.
Second Degree Murder: it is somewhat the same with First Degree Murder. The difference it with the senctence the could be charged with. The maximum sentence for a second degree murder conviction is imprisonment for life with parole eligibility after fifteen years. It should also be noted that, unlike first degree murder, a defendant in a second degree murder case may waive the right to a jury and submit to a trial in which a judge determines guilt or innocence, otherwise known as a bench trial. |

I say "Innocent".
The jury convicted based on feelings, not on facts. There were many reports that there was NO "concrete" evidence linking Scott Peterson to the crime. That is what Dr. Henry Lee said. There was enough reasonable doubt, and you're only supposed to say "Guilty" if one is guilty "beyond a reasonable doubt." No evidence of the crime, no method of death, no link between Laci's death and Scott other than Laci turned up at Scott's place to fish. That sounds like circumstantial evidence to me. I would never convict. |
There was not evidence so they legally couldn't convict him this will be overturned on appeal...

It'll be difficult to sentence him to death because it was a circumstantial case. He'll most likely receive life imprisonment.
