BestBuy Fires Sick Employees
 
Listen to this..

My girlfriend works at BestBuy, today she went to the doctors to have a blood test and a check up because she was bitten by a tick and has a severe red dot and a big hole in the side of her leg, which is a classic sign of lime disease.

She called BestBuy and told them that she will be an hour late because she is at the doctors (keep in mind she works durning the day and had off saturday and sunday, when doctors offices are closed).

When she came into work, the managers yelled at her, made her cry, and fired her for being late.

What do you guys think of this?

My brother had to sue them for a year of backpay, because they had given him a lower wage than what they were required by law to provide. He got a $3500 settlement.

Get an Attorney!

Most attorneys would take a case like this, if in fact the details were what you described, and the good part is they would do it on a contengency deal.

Sounds like you have a lawsuit.. Call legal avisior immediately, document it, make a complaint at your local labor board.. and get the ball rolling.. Something as serious as potential lime disease is serious and they should show some leeway on that...

The management at that location sounds like a total asshat..

Yeah, there really arent too many other details, its pretty streight forward.

She was a customer service senior and while she was their she had increased their sales percentages (Replacement plans, etc.) and devloped a 20 page training packet for training new employees.

It seems almost mind bogling that they would do that..

Document that as well... That is extra sob leverage against them, who knows they may hire her back and offer some kind of compensatory out of court thing...

Did she have a History of being late for work or taking off too many days? Did she have problems with her boss? Did she ever get into trouble at work?

I'm not saying your girlfriend was at fault, just trying to figure out the situation. Sounds very odd and I don't understand why any boss would fire somebody for something that simple, I'm sure they know of the repercussions that would ensue.

Who fired your girlfriend? Store or department manager? If it was the department manager, go to the store manager. If it was the store manager, go to the district manager.

I think she did have one other write up for being late on one occasion.. So potential it could be said that it is a reoccuring problem, however, given the situation it does not seem justfiable that they would fire her, its one thing if she didnt call and came in late or was out partying and was too hung over to come in to work, but she had a potentially very serious disease.

If that was the first time she's been late and she has a doctor's note then she definately has an easy law suit.

Call up a bloodsucker lawyer and she'll get a nice settlement.

(edit: just noticed you said it happened once before, shouldn't matter if she has a doctor's note)

Not sure how this applies to every job out there, but my family's business has unionized staff and a doctor's note is a requirement if they want to take a sick day. So that means the day they are sick they have to go to the doctor to get a note. They can't just stay home and sleep. They make exceptions all the time depending on the circumstances, but if they get an asshole employee they will hold them to it so they don't have to pay sick time.

Get anote from the doctor about the appointment, Drop it off to the Store Manager, Give a copy to the general manager, make sure the note explains the urgency of the appointment, File a complaint at the labor board, give them the doctors note also.. Get your legal counsel.. Then have his/her ass hit up the local media networks, they will have a field day with it...

You should have a settlement in no time!!! :2 cents:

I find it hard to believe that she is this model employee and then gets fired after being late and calling in beforehand and its only the second time. You think about going to a lawyer you need the whole story from her or best buy will tear her to shreads in the court room.
