Fuck IBILL - anyone thinking about a class action suit?
Seems like we are going to have to wait at least 2-3 more weeks to START getting paid (they originally said they would be caught up by 10-31). By then they will be THREE weeks behind. Meanwhile, they continue to bill and rebill customers which we have to pay BW for.
Do they realize that they will probably not have any clients left if they keep delaying payments? Does anyone in here actually think they are going to pay us a nickle of what they owe us? I forsee a chapter 11 in the very near future. When a company stops answering phone calls and starts avoiding lawyers/creditors, bankrupsy is usually the next step. If anyone is considering a class action suit, hit me up on ICQ. I'm in. |

It involves more than you.. I doubt anyone would be inclined to participate in any Class Action with ya. It does take some sense and jugdement along the way. |
do you have a short memory? all the others that had problems paid no one shit and then closed. iBill is letting you know yes they will pay its important to them but it will take a little longer. I hope if you ever have financials difficulties the people you owe money too are more patient than you have been. Remember do on to others as you would have them do onto you.

What I'm basically saying is ya gotta evaluate the scenario fully and act in your interests to achieve the best outcome. |

Even if Ibill was to go down, why is it much concern to you? You support Bush, right? The party that has demonstrated it won't tolerate porn and may eradicate porn altogether. Good luck on getting class certification before First Data is required to pay out.
Your better off suing on an individual basis, its cleaner and would proceed faster to a summary judgement on a breach of contract claim. |

The contract for iBill states payment will be forwarded as soon as "practicable" but that isnt a carte blanche statement that allows iBill to pay out whenever. Courts will look at past practices to determine what is reasonable and if iBill had established a routine for 7 years of paying out after 7 or 14 days then you have a clear pattern of what is the deal and when it is in breach. Ok that being said, lets hope payout happens soon so iBill doesnt get swallowed up in legal fees defending itself against claim after claim. That alone could force them to shutter their doors. |
