Fuck IBILL - anyone thinking about a class action suit?
 
Seems like we are going to have to wait at least 2-3 more weeks to START getting paid (they originally said they would be caught up by 10-31). By then they will be THREE weeks behind. Meanwhile, they continue to bill and rebill customers which we have to pay BW for.

Do they realize that they will probably not have any clients left if they keep delaying payments?

Does anyone in here actually think they are going to pay us a nickle of what they owe us? I forsee a chapter 11 in the very near future. When a company stops answering phone calls and starts avoiding lawyers/creditors, bankrupsy is usually the next step.

If anyone is considering a class action suit, hit me up on ICQ. I'm in.

It involves more than you..

I doubt anyone would be inclined to participate in any Class Action with ya.

It does take some sense and jugdement along the way.

do you have a short memory? all the others that had problems paid no one shit and then closed. iBill is letting you know yes they will pay its important to them but it will take a little longer. I hope if you ever have financials difficulties the people you owe money too are more patient than you have been. Remember do on to others as you would have them do onto you.

Your point is well taken. Unfortunately, I (foolishly) had too many of my adult eggs in the ibill basket, so this affects me more seriously than most. It's really hard to know what to believe when you see conflicting info posted all over the boards and ibill NOT answering questions. It looks like they are avoiding the issue, which is NOT a good sign.

It's just the postings and the judgement that may already have given a clue.

Sure, iBill are in a mess... that is not new. Why has the company been changing hands and "restructuring" so often?

If iBill closed doors tomorrow, a Class Action suit is pointless.

If there is a serious problem that needed action before they closed doors, - it's something that has to happen within hours with the object of securing either funds, databases or whatever.

It's a matter of judgement by others, probably depending on the losses they would suffer if that were to happen.

By luck and some planning, I never allowed iBill to place me in a situation where their downfall would be too significant. But it's clear that is not the case with some other folks and there is obvious concern.

If these folks think iBill is going to be a problem, they may, based on any communications with iBill and their track record, feel a need to act. I can't say for others - they may have a lot to lose - but Class Actions are just words when a company is in shit. Actions now count more, tho some of these actions may be part of the legal process, some possibly not and by negotiation.

What I'm basically saying is ya gotta evaluate the scenario fully and act in your interests to achieve the best outcome.

Good luck on getting class certification before First Data is required to pay out.

Your better off suing on an individual basis, its cleaner and would proceed faster to a summary judgement on a breach of contract claim.

What are going to say your honor they had financials problems and it took them a whole 6-8 weeks to be current with me when others just closed or filed bankrupcy. What a waste of the courts time.

Why sue them for your 12$ check .. not really worth it

First I am not suggesting a lawsuit, only that a class action would likely not be the way to go. Secondly, there is a claim here Tony. You are suggesting in your post that they will pay out soon, what happens if they don't? Would you say after 30 days of non payment there is a claim for breach of contract? 60 days? 90 days?

The contract for iBill states payment will be forwarded as soon as "practicable" but that isnt a carte blanche statement that allows iBill to pay out whenever. Courts will look at past practices to determine what is reasonable and if iBill had established a routine for 7 years of paying out after 7 or 14 days then you have a clear pattern of what is the deal and when it is in breach.

Ok that being said, lets hope payout happens soon so iBill doesnt get swallowed up in legal fees defending itself against claim after claim. That alone could force them to shutter their doors.
