Spamming is not a LEGAL issue
Its a technical issue. Its a standards/protocol issue.
Laws are often too slow and antiquated to deal with fast moving and ever changing technology. The battle against spam should be fought in the marketplace of technology not in the judge's chambers. What's your throughts on this line of thinking? |

Not sure I agree or disagree. Both places seem about right, lol.
One one hand, the can-spam law sets standards of definition which are needed in order to prove one way or the other. One critical factor is still the power of upstream providers to hosts which can and do withhold complaints, yet force hosts to shut down domains which they get complaints from. They dont bother to check for compliance, which basically undermines the legit mailers rights to an extent. That is, even if you're fully compliant, a few assholes can complain up the line and get you shut down if they're smart and persistent. |

Our government has no idea how this works. They did more harm than good; They just made spamming legal.

The only way to stop most spam is to make the spammers pay. By charging the excessive mailer a small fee it will be unprofitable for them to mail out. Most people will be able to operate within their "allowance" spammers sending out millions will have to pay. They will not be able to hijack mail servers becasue again it would set off an alarm that a payment is due. For those who think mail should be free there should be free mail services, that people can opt to recieve from or not. Until then we are left with the software option that also stops important legitimate mail. |
