He was talking about the characteristics of a judge he would appoint and gave an example that involved slavery. He would want a judge that would interpret law based on principle/Constitution rather than personal beliefs or whims of the times. Perfectly legitimate:2 cents:

or it shows how people don't listen! he clearly was talking about judges interpretations of the Law, and clearly gave an example of how one Judge argued that the constitution supported slavery - pretty simple.

He was using a historical example to explain the kind of judge he would not choose to be in the Supreme Court
