United States (Arrested)

I dont know it anymore, i did do everything to find information about it. end of july i got arrested and there were 48 people here, the case is not important. i didt do anything, i did sit 3 days in jail, everything fine and nice but if i want to fly somewhere, united states or australlia, they are asking me if im arrested on the visa waiver? the judge, not real one the one in the 10 days period said you can go home and you didt do anything, but a i arrested then or what? i dont know it anymore.

if this is try my whole life is fucked up because of anothers and i didt had anything todo with it, its on paper, etc.

i did spoke to 2 visa offices they are saying to me i need to put NO on the paper, but thats lying i think, i dont know it.

is anyone ever arrested and did you go to the united states without problems or not?

anotherwise im going to sue the police here, because i want to visit the united states for sure too.

i lost my company of this and everything, i did get my stuff back after 3 months now finnaly.

That's good advice. If you want to know the right answer, ask a lawyer or search heavily on google.

stocktrader23 10-07-2004 03:04 PM

Criminals can't fly? That's impossible.

infatu 10-07-2004 03:05 PM

If you weren't charged you can say no. If you were charged but found not guilty you can say no. Unless you are convicted they cannot make your arrest record public.

Unfortunately for me, I was convicted and now have to wait for a waiver to enter the US. The shit's costing me over $2000 to get processed. All for getting drunk and playing basketball at school after hours. (3 am) :1orglaugh

Hansm 10-07-2004 03:06 PM

offcourse i can fly. but cant pass the border, why would i fly 8 hours then.

and read everything, my layer doesnt know it and 4 anothers either.

Furious_Male 10-07-2004 03:08 PM

Sounds like you need a new lawyer if he doesn't know what the fuck is going on. Good luck.

Hansm 10-07-2004 03:11 PM

im not convicted or charged. im arrested and on the visa waiver paper is standing:

Have you ever been arrested or convicted for an offense or crime involving moral turpitude or a violation related to a controlled substance; or have been arrested or convicted for two or more offenses for which the aggregate sentance to confinement was five years or more; or have been a controlled substance trafficker; or are you seeking entry to engage in criminal or immoral activities?

above question is the one on the visa waiver form, below i did find on internet, i already tried to find for the last 10 days getting crazy from it.

im arrested, but i did get out of problems in 3 days and i was fully free to go, dont know the english word for it, i didt had anything todo with it.

Important: Some travelers may not be eligible to enter the United States visa free under the VWP. These include people who have been arrested, even if the arrest did not result in a criminal conviction, those with criminal records, (the Rehabilitation of Offenders Act does not apply to U.S. visa law), certain serious communicable illnesses, those who have been refused admission into, or have been deported from, the United States, or have previously overstayed on the visa waiver program. Such travelers must apply for special restricted visas. If they attempt to travel without a visa, they may be refused entry into the United States.

When Does a Citizen of a VWP Country Need to Apply for a Visa?
You must apply for a visa under the following circumstances, if you:

want to work or study in the United States; or
have been refused a visa before; or
have a criminal record; or are ineligible for a visa

I would think they want to know if you were arrested and charged. If you were not charged, if you were found to have had nothing to do with whatever reason they arrested you then I can't see a problem saying No.

Drake 10-07-2004 10:45 PM

:question

volante 10-08-2004 12:35 AM

Say "no" to everything. The worst they will do is refuse you entry to the USA.

Say "yes" and you'll probably get interrogated, then refused entry.

Gunni 10-08-2004 12:52 AM

if you were not sentenced then you have nothing to worry about,
I'm 100% sure, I've been to the states, and I have been arrested :)

Hansm 10-08-2004 12:43 PM

sentenced? whats that? too far for my english knowledge.

Hansm 10-09-2004 01:08 PM

the whole strory.

a guy got shot, they used my brothers car, my brother called to come there fast to his home and take my phone, so i did order a taxi, forgot the taxi, did drive with someome else to there, when i was there i got maybe 25% of the story from another guy and said shit i need to get out of here, i did call a taxi with my brothers phone it was tapped by the police, and said to the guy from the taxi central i dont know what im doing today because i needed to get away there, they were thinking i shot or something, 4 hours later 48 people from the police did got in my house and i did sit 3 days in jail, lucky i had enough of proof i was away that day and the judge said after 3 days you can go, first meeting of judge, i dont know the name of this judge, rechter-commaris in this country, she sad i was free to go and nothing to worry about anything. first of all i didt had my drivense license, how can i be in 10 minutes 40 kilometers further lol, flying. not. 3 days were worse. but im never charged or convicted because i didt do anything, so do i not have the worry about anything? and just go to the united states and say no?

they did control all my clothes, they did take everything here.

i still cant believe 48 people from the police did come lol.
