Not true.

If we have a good solid democratic house and senate, scalia or another conservative justice retiring would be a great thing. If the dems control the veto, they can block anything that extreme from getting in with relative ease.

It all depends on who gets voted in. This is why your vote counts even if you're in a state that you already know who is going to win the presidential.
