German Censorship Agency Letter Received Re. Paysite tour
 
Has anyone else recieved on of these from BPjM ?

Basically it says that the spreading of pornographic content via the internet is a criminal offence under German jurisdiction.

Site tours are included unless an approved age verification system that can guarantee minors cannot access any content including advertising context are used.

Continuing violations will be punished by law under German jurisdiction and you have 14 days to defend against the charges (or remove the website or place an avs infront of the paysite tour). (the letter came registered)

I am not in Germany by the way and am hosted in the US.

I got a cover letter explaining the basics of who they are, what they do and what the process is.

They also sent two documents German which seem to outline the offences.
It also says something about sites that are linking to your site are also offending by way of advertising indecent materials.

Redirecting all German traffic to that particular site off to a bland restrcicted access doorway or a "sorry no Germans allowed page" sounds like the easiest solution to keep them happy.

So, someone in Germany reads that and it DOES violate the community standards of their country ....... legally, can Germany go after someone from another country?

I know Germany has extremely strict laws about what you can send via the mail. You can't send any material that is sexual, even r-rated, unless you send it to a registered business.

i don't think that anyone from Germany will go after someone from another country. If you are not a german, not hosting in Germany and not using .de domains nothing will happen. No one can tell you not to make websites in german language.

and such disclaimer you are using are not worth the webspace - they're bullshit. are you a german and living in Germany? than you have to follow the law and use an AVS (which is btw the biggest nonsense ever). If you are not living in Germany fuck the german laws.

I got that letter as well a few weeks back.

- they don't say they go after you
- they have to send out these letters if someone complains about your website. That's their law
- If you don't follow their instructions they'll set you on some sort of blacklist --> then it isn't allowed for other germans to advertise or link to your site. That's all...

so you can just ignore the stuff and wait for the second letter to arrive (that they've put your domain on that blacklist). Needs ~6-8 weeks

I'm not sure what happens if you visit Germany. Usually they don't arrest you if it's just straight porn. If it's cp or beast then you get assraped

Yep, After reading over it a few times its clear that the site will be put in the index as the tour is not protected by an AVS and they will then send that second letter advising of this.
I dont think it can go further than that either but I'm sure the second letter will have more info and it does state that you can alter the website after recieving the 2nd letter to remove the "incriminating content" and then ask for the site to be removed from the index, so I dont see any trapdoors at this stage :)

Nobody's webserver "transmits" anything.. They merely Serve what is being Requested.
