Microsoft sues more spammers
I wonder how many people we know and do business with are being affected by this latest round of lawsuits.

September 23, 2004: 7:20 PM EDT SEATTLE (Reuters) - Microsoft Corp. filed nine new lawsuits against spammers who send unsolicited e-mail, including an e-mail marketing Web hosting company, the world's largest software maker said on Thursday With the latest batch of lawsuits, Redmond, Washington-based Microsoft (MSFT: Research, Estimates) said it is involved in more than 100 legal cases against spammers, including more than 70 lawsuits filed in the United States. Microsoft has launched a barrage of lawsuits against spammers over the past year in an attempt to curb the spread of unsolicited e-mail pitching everything from get-rich-quick schemes and herbal remedies to penis enlargements. Microsoft said it filed a lawsuit last week in Washington State's King County Superior Court against Web hosting company National Online Sales and its owner Levon Gillespie, as well as those who used his services, for offering ``bulletproof'' services for those seeking to send marketing email. Gillespie was not immediately available for comment and e-mails sent to his company's site were not immediately answered. Aaron Kornblum, an attorney for Microsoft, said the Web hosting company, which offers space on computers for serving Web pages and sending e-mail, based its operations in China so the sites would not be shut down. ``This is the first action against a Web host catering to spammers,'' Kornblum said, ``they're providing a safe place for spammers to drive customers to.'' The other recent lawsuits filed by Microsoft were against spammers sending unsolicited e-mail. Kornblum said that by taking legal action, Microsoft is ``trying to change the economics of spam'' by making it costlier for spammers to continue their activities. |
so, I wonder how many spammers are closing up shop today now that they heard the news...
it is a valid approach they're taking that I'm shocked hadn't happened yearrrrrs ago.... |

so what exactly gives Microsoft the right to sue these guys? They can't just say hey you are a spammer and sue them.. Has to be something that is affecting microsoft.

And what is Microsoft??? Realistically, one has to look at what makes sense. As surfers get more aware of what's going on, they will stop answering spams, so cash in as long as it's possible. Won't last for ever. Deceptive business practices can only be ephemerous. |
Most all operations have some sort of US assets that can be attached in judgment enforcement.
CAN-SPAM Act + State Laws + Hotmail = Right to sue, more then likely. CAN-SPAM Act section which allows state laws to remain enforceable. SEC. 8. EFFECT ON OTHER LAWS. (b) STATE LAW- (1) IN GENERAL- This Act supersedes any statute, regulation, or rule of a State or political subdivision of a State that expressly regulates the use of electronic mail to send commercial messages, except to the extent that any such statute, regulation, or rule prohibits falsity or deception in any portion of a commercial electronic mail message or information attached thereto. |

I have about 20 e-mail addresses, and get tons and tons of spam.
But I would rather hit the delete button a few times a day then to have to mess with getting rid of a virus. That takes hours. The spam takes minutes. If thay put more effort in getting the people with the trojans and things like that, they would also shut down the majority of spamming. |

I am usually not too pissie when it comes to spam but those folks over at www.cheapseats.com have me close to melting point. They keep trying to opt me into their list and I've replied to be removed, gotten confirmation that I was removed, then I still get 5 damned emails a day trying to opt me in. That's the kinds shit that pisses me off. If someone says remove, then f*ing REMOVE THEM!!! If they don't, they deserve to have a big Hawaiian pineapple grow up their butt and get sued! LS |

you do also realize that MS is trying to get into bed with ironport systems, which also owns spamcop.com. biggest, best spam machines buying the largest and most widely used anti-spam/spam reporting website.
ms ought to be working on securing thier software prior to its public release rather then trying to fight a battle it can not win. |
