Doctor acquitted of sexual charges resulting from hallucinogen.
Haifa District Court on Sunday acquitted a doctor from the north of the country who was accused of sexually abusing one of his patients while she was under anesthetic. Before surgery, the doctor had injected his patient with an anesthetic which can cause sexual hallucinations.
The judges ruled that the doctor had been rash and negligent in his decision to inject the substance without a nurse present and without making sure that the patient had fasted before the procedure. The court will decide whether to convict him on negligence charges at a later date and it is possible that after further testimony is heard, the doctor will be sentenced to public service. The case began in 1998, when a young woman from the north arrived at a clinic in Nahariya, after she was referred by her family doctor to undergo surgery on an abscess in her back. The doctor explained that he would administer the anesthetic - Dormicom - alone as a result of a nurses' strike. The doctor injected the woman with the drug and performed the surgery. When she awoke, the patient went for a dentistry procedure, where she seemed distraught and claimed that she had woken up from the back surgery and found the surgeon taking advantage of her while she was under anesthesia and forcing her to perform oral sex on him. During the trial, the judges discussed the various side effects of Dormicom and heard expert opinions that the drug was widely reported in medical literature to be a hallucinogen. The judges were eventually convinced that there was no proof that the doctor had subjected his patient to any acts of sexual assault.
