Six Austin-area adult video stores will be seized and sold by the federal government after a Texas man was sentenced Friday to more than five years in federal prison for mailing fraudulent tax returns and selling obscene videos.

John K. Coil, 62, of Highland Village, near Dallas, must surrender Dec. 1 to begin his 63-month sentence, Senior U.S. District Judge Harry Lee Hudspeth ruled. Coil, who pleaded guilty in June, was also ordered to pay a $5,000 fine.

"Today is a good day because a long-time merchant of hardcore, triple-X rated, sadistic pornography is on his way to federal prison," U.S. Attorney Johnny Sutton said.

As part of Coil's plea, he surrendered 45 Texas properties owned by various corporations and trusts to the government ? including the six in and around Austin, all named "Adult Video."

Those properties include houses, offices, at least two dozen adult video stores and vacant pieces of land. The video stores are in cities including Austin, San Antonio, College Station, El Paso and Houston. With the exception of the Houston-area stores, the pornographic books, movies and other novelties in those stores will be destroyed by the government. The Coils will keep the contents of the Houston-area stores under the deal.

Sutton said the stores in Austin and other cities will be auctioned and that the merchandise that was part of the investigation will be destroyed. Sutton said he did not know whether the Austin-area stores remained open Friday.

Coil's sentencing concludes a case that began in the mid-1990s when Austin police detectives noticed what federal prosecutors have described as "financial irregularities" in Coil's business operations. They passed the case to federal agents, whose investigation culminated in a 32-count indictment against Coil and six others last year.

Each of the defendants, several of whom faced up to 20 years in prison on racketeering charges, have pleaded guilty and have been sentenced. They included Coil's son, daughter and wife, whose penalties ranged from probation to year-long prison terms.

John Coil's lawyer, John Fahle of San Antonio, said his client will appeal.

Between 1990 and 2000, nothing happened. Case was shelved, tossed around, not important. A deal was in the works involving the payment of taxes owed, a fine for late filing and a penalty for tax evasion. Just like in most similar cases not involving porn....

The case had nothing to do with selling porn. But did the sentence.

He would of been prosecuted anywhere and in any business for dodging taxes. But was his sentence in line with what other taxes dodgers recieved? Was the investigation and prosecution related more to what he sold than to the tax crime?

In Sacramento, California, Lonnie D. Crockett was sentenced to 42 months in prison followed by 36 months probation and ordered to pay a fine of $67,500. Crockett pled guilty to defrauding the IRS in a nationwide tax evasion conspiracy that involved the concealment of income through a chain of domestic and foreign bank accounts and trust arrangements. Three doctors from northern California also pled guilty in connection with the scheme. Daniel Bullock, an orthopedic surgeon, Richard D. Pfeiffer, an orthodontist, and Richard Shearer, an ear, nose and throat specialist, were sentenced to prison for 18 months, 27 months and 24 months, respectively, and ordered to pay fines and back taxes.



In Greenville, North Carolina, Charles James Payton was sentenced to serve 78 months in prison followed by 3 years supervised release. In addition, Payton was ordered to pay restitution to the IRS in the amount of $87,073. Charles Payton was convicted on of seven counts of willfully aiding and assisting in the preparation of false income tax returns and one count of conspiracy.



In Reno, Nevada, Palle "Pono" Bognaes was sentenced to serve 80 months in prison and 3 years supervised release, and to pay $29,598 in restitution to the IRS for conspiring to defraud the United States, evading more than $2 million in federal taxes, and obstructing and impeding the IRS in the collection of those taxes. He also was ordered to pay $107,752 in restitution to a client from whom he took unauthorized withdrawals and to pay $4,861 for costs of his prosecution.
