Question about new 2257 law
 
Question, anyone know If a picture is hotlinked on my website from another person's host, am i still responsible for the hotlinked content under 2257?

yes it's okay, since the sexually explicit content is on a server that you have no direct link with.

This advice may land you in jail. It's YOU website so YOU are responble for the 2257 info. If I don't have my 2257 info the government is going after ME not my host.

Yes you would have to have 2257 info to have it appear on your page even though it is hosted on a different domain.

the proposal says:

(2) A secondary producer is any person who produces, assembles, manufactures, publishes, duplicates, reproduces, or reissues a book, magazine, periodical, film, videotape, a computer-generated image, digital image, or picture, or other matter intended for commercial distribution that contains a visual depiction of actual sexually explicit conduct, or who inserts on a computer site or service a digital image of, or otherwise manages the content of a computer site or service that contains a visual depiction of, actual sexually explicit conduct, including any person who enters into a contract, agreement, or conspiracy to do any of the foregoing.


You would come under "manages the content of" because you have control of the html code that is causing the image to appear on your site.

That is of course just imho....

i was under the impression that if you host no images, you dont need 2257 records.. thus you wouldnt need the 2257 records if youre hotlinking an image from your sponsor.

This is where the law is fuzzy. Define "who manages the site".

Is it the person who has created a website using hotlinked images from someone else's server. The person who created the site manages it, but selecting to put that picture on his website.

Or is the person who is being hotlinked the person who is manages the website, being as he is the person who decides which content is on his server?

Or both of them?

so much of this law is fuzzy, it sucks ass....

can anyone clear this up before we have a chance to consult an attorney...i am writing him an email now though

let me give a totally non legal opinion...
if the image shows up on your site, whether hotlinked or not, you are responsible for it....

Wouldn't issues like this have to be resolved in courts and which company/individual will actually be pulled into court for this? Would the US file a class law suit against its own working citizens? In either case it makes sense to use proper non abusive content now call me conservative, but I think you can do a lot with a hot female body and not bring scat/equipment/violence+blood into the shot or any of the more twisted images. Sure I say hell lets get their 2257s and make sure they're legal while we're at it :)
