a fucking DVD movie... hit and killed someone, and is being charged with murder - not vehicular manslaughter, or straight manslaughter, but murder.

I wonder what he was watching? "Fast and the Furious"?

I don't know why they go for murder...they have that one Law and Order show where they follow a real case and these 2 guys were racing down Imperial Hwy in San Diego with their lights off at night and hit and killed some teenager...they were charged with murder but of course were convicted of vehicular manslaughter.

They are probably charging murder to let it get reduced to vehicular manslaughter, rather than having it reduced to something less. Plus, murder gets more headlines.

--no. Motive is not a requirement to find anyone guilty of any crime, including murder. Lawyers present motive because it is natural for juries to question "why would he do that?" and could subsequentlt question the person's guilt--thus they tell you why to stop a juror from feeling empathetic toward the defendant.

Trials are negotiations....the full muder charge is a scare tactic to get the defense to plea to a lesser, but serious charge.

Murder doesn't have to have motive but it does have to have intent. Soooo for it to be manslaughter, you basically have to have someone who kills someone without meaning to, and without the knowledge that what they were doing would cause death.

Murder has to have a person knowing that their actions could result in death, but continues on.

I would think getting into a vehicle weighing over 1000 pounds, in a place where there are pedestrians and other vehicles, and making the choice to watch a DVD instead of the road would meet the requirements for murder....

no, there does not have to be motive . . . . that is on TV only, it is sufficient if the acts done apparently endanger. life, and eventually fatal . . . In other words, if you do something that is dangerous, and puts others at risk, and it kills someone, you can be charged with murder.

There are different degrees of murder, and this will probably be second degree, or even a lesser included of manslaughter

well, manslaughter is murder:

here's the difference: You plan on killing someone (let's say you're OJ)---you get the mask and the gloves and sneak over an kill: premeditated = muder one

You're a bank robber, you have a gun. You don't want to kill anyone but you do. Death during the comission of a crime = categorized differently, but you'll still get the penalty (-death) of murder one.

You get in a bar fight. (not self defense scenario) the guy hits his head or something and dies---manslaughter. Unintentional death due to negligence or other tort (crime involving injury)
