2257 remark....
 
If 2257 affects secondary distributors of sexual material, such as webmasters using thumbs to link to hosted galleries, wouldn't it also mean that video stores (be it rental places or purchase points) along with corner stores that sell erotic magazines all fall under the same category and also become secondary distributors, requiring places such as 7/11 to be able to provide access to 2257 documents for the models featured in the magazines they sell?

You can enter a video store that sells XXX movies and look at the pictures on the back of the box. (in a rental place or in a shop).

Correct me if I am wrong.

If it doesn't apply to video stores, it then couldn't possibly apply to a TGP with non-nude thumbs linking to content because only AFTER you click the thumb do you see the content.

It says nothing about secondary distribution, it is secondary production that is mentioned.

Video / book stores are not producing anything, they are merely distributing it.

However, let's say they ripped this month's hottest DVD to make a commercial out of it to play on monitors throughout the store... then, (copyright laws aside), they would need to have the docs, as they have now (re-)produced something and are secondary producers.

Putting a text link up on your site = distribution
Putting a linked image up on your site = reproduction

Use non nude thumbs, like face only shots, (to be real safe, you could even shy away from "moaning" type pics), and you will be fine. You are now no more offending, hell, even less so, than a JC Penny's catalog.

The law pertains to images on your server, not to what you are linked to.

They aren't immune, what I'm saying is that if they themselves are not displaying images, they have no 2257 issues at hand.

Edit:

You should / probably will still be required to have a 2257 statement listing your reasons for exception.

This is what I am wondering, possibly not, if the thumbs and pics on the TGP do not show nudity or sexual poses?

so if they are NOT nude, you are safe, as long as you are linking to a gallery NOT on your server.

As I, and a competent attorney who owes me some favors understand / interpret it, yes.

Remember though, under the new revisions, banners are subject to compliance as well, not just "content" images.

I hope all this is clarified before the law is voted.

As I understand it - if you have a thumb displayed in your site - even if hot-linked...you need 2257.
