A good idea would be taking a shit on there porch and leaving the papers underneath it! Or just have some chick stand outside there house with no shirt on and have a sign saying "You have just lost half of everything" This way at least with someone naked the news wont be so hard

there are companies that specialize in that.

They handle that part and stuff.

I think there is one by me called Accuserve

I'm suing the guy who did some body work on my car but did a shit job...

I went to personally serve him today and i caught him as he was driving away, so he stopped and asked me what was up... i said not too much then got out of my car and walked over to him and said i had something for him.. i placed the papers on his arm (his elbow was out the window) and he started to read the shit then pushed them out the window and drove off.

I called the courts and they agree that i've served him but i wouldnt mind doing it a second time but this time adding some humor to it :thumbsup

Get a woman to serve him. He won't be expecting that. :Graucho

GRab him around the throat, and when he starts to gasp for air, shove em down his throat. He will have no choice but to grab them.

Porn4abuck 06-28-2004 02:43 PM

If you are sueing for damages that would including any sort of money, you have to have him served in person and he has to sign the document as well as the person that served him the papers as a witness. Thats a must.

If you dont server in person you can not collect any money damages.

Hire a company to do it for you. Call your local court house, Im sure they have a list. Its not expensive either.

I do not think courts allow you the plaintiff to serve process yourself unless done by an alternative method usually granted under an order by the court. You usually have to have a independant third party serve the papers and file an affidavitt of service. Read your local court rules some states allow service by certified mail return receipt requested with restricted delivery noted. The best way which I use is to let the sheriff serve the papers, since they usually do it in uniform and it is a wake up call.

Also make sure you are suing the right person. If it is incorporated you need to sue the business not the person and serve their registered agent which is on file with the secretary of state.

P.S. This is not legal advice!! You should always seek legal counsel. That is my advice!

not in California, knock on his door and if he opens it he's served even if he slams the door shut you just lay the papers on the ground. He better show up for court. I got servered that way once and thought I wasn't served. :Graucho

they don't have 2 sign anything,

That's usually true. Since he screwed you, I'd suggest having the local sheriff serve him. :winkwink:

If you wanted humor, my favorite way of serving someone was following them to the bathroom, act like I was doing my business, go to wash my hands, ideally your mark would wash their hands too if they saw someone else doing it, grab a paper towel for myself and and I would hand them their papers and tell them they were served. :1orglaugh

Then I'd would bolt out of there like O.J.

But honestly, let the Sheriff do it, nothing gets their attention more than having a cop car pull in front of their office or home, stand on their doorstep, hand on the gun if they get stupid and serve them papers.

Its a real wake-up call to them that you mean business, its a real deer in the headlights look on your mark's face when that happens.

The person to do the service has to be authorized by the court I believe. When you can't find someone, there are alternatives. All laid out nice and neat in the Rules of Court and in the Statutes for your state. A trip to the law library sounds like fun.

I'm not an attorney. Smart to rely on a real attorney in your state.

1. Hack his computer.
2. Tap into his phone lines.
3. Intercept a online grocery delivery and have your process server pose as the deliveryman for the store.
4. Actually deliver some of the groceries.
5. Have the process server take a camera.
6. Hand the guy the grocerires.
7. Then give him the court papers.
8. Snap a picture of the person who answers the door.

This is how someone tried to serve me. Of course, I wasn't there, but the plaintiff violated all kinds of laws.

If you don't care who you hurt or how many computers and phone lines you hack (federal violations), then serve the bastard and suffer the consequences.

IT'S A DIRTY FUCKING WORLD!

In CA, anyone over the age of 18, that lives in the county can serve the defendant

where do you live? he has to sign? that will never happen . . . who would ever sign a S&C if it meant they would be not be subject to damages if they refused?

Take a staple gun, walk up to him and staple it to his forehead.

latinasojourn 06-28-2004 10:45 PM

in many areas you can hire the local sheriff to be a process server.

this is the best. few people will run from an officer in uniform, and it gives a nice official touch.

will generally cost $50-100 extra, but worth it if you are trying to recover anything substantial.

very good when evicting nonpaying tenants.
