Gahh..fucking drunk drivers. My car is totalled...
 

Was driving home on the freeway last night while it was pretty wet out. Some drunk girl in a newer Eclipse slammed into another car, which then spun out and hit the back left quarter panel of my car. That spun my car 90 degrees to the right so that I was sliding perpendicular to the freeway, then my car hopped the median seperating the freeway from the exit lane, high centered on it (it was about 5 feet wide - basically fit between the front and rear wheels of my car), and slid like that for about 20 feet - basically just tearing the shit out of the bottom of my car. The entire exhuast was on the ground, along with tons of miscellanous parts I didnt even recognize. The rear frame looked bent, the entire back end is fucked, and there are paint scrapes on pretty much every part of the car. And to give you and idea of how hard I got hit, both fog lights were hanging out the front from the impact.

I'm told the girl was INCREDIBLY drunk, and was the only one that walked away unhurt. I had to go to the Hospital for X-rays and a CT scan, but everything checks out - besides a terrible case of whiplash.

I should have pics of the accident soon, I had a disposable camera in my car and the film is getting developed. But until then, here are some pics of the car before the wreck. Such a shame it had to go this way :/

And just out of curiousity - anyone have advice on how I'd go about filing a suit against this girl for personal injury, pain and suffering, etc..? I'm totally clueless where to even start with that.

Its completely fucked. Brings a tear to my eye, seriously, I just got the freaking car a month ago!

All I had was my disposable camera though, so its gonna take a few days to get the pictures.

This is actually the second time I've been rear ended on the freeway this year. Last time was in my old '96 Corolla, I got slammed by a semi at like 15mph and had 6k in damages done to a $4,000 dollar car :1orglaugh

But I didn't get hurt that time...and I didn't care about THAT car. This bitch is gonna pay this time! :mad:

Apparently the Camera is some special recycled camera, that can only be developed by certain companies. They pick up the cameras every day, develop the film, then drop them off the next day. Sounded fucking odd to me, but whatever.

Sorry about your car bro that sucks. But I must say, Why the fuck are you sueing for personal injury, and suffering. You just said you checked out fine at the hospital. Why must everyone jump so quick to a lawsuit. Im not just saying this towards you, but I have seen it alot lately.

Like last night on mtv I think it was. The guy that was 'held under water' to long on fear factor, he decided to sue and he has now been out of work for months. What kind of bullshit is that? The guy looked totally fine.

I had two friends killed by a drunk driver while they were coming home from fishing. Fucker barely did any jail time, and was completely uninjured after going head on into my friends car.

Have an attorney contact her insurance company and let them know they will be REPLACING not repairing your BMW or it's lawsuit time. If YOU deal with the insurance company they'll go for repairs. Fuck that. The money spent on a lawyer is worth it when dealing with an insurance company that you have a fat claim against. I had a friend have the same thing happen with a one month old convertible Corvette last year. Drunk uninsured loser in a $300 car runs a red light and smashes and bends the fuck out of it. Her own insurance company would only pay for repairs that took six weeks due to a variety of problems. Needless to say, the car is now a rolling piece of shit.

Just what I was thinking. If you are not hurt get the money to get a new car and move on.

Man I feel your pain. I had my 2004 M3 for 7 days before I got into an accident and did $28 000 in damage. Hope it all works out for you.

if she was given a DUI on the case, you pretty much have an open and shut case (even though no cases are really open and shut) for the damages of the car.

If you do sue for pain and suffering, you are going to be going up against not her, but her insurance company, at least this is what I've seen from personal experience. You can claim all the pain and suffering you want, but if you don't have medical backup, then it most likely won't hold.. so unless you have any casts, serious medical issues resulting from the crash like severe migraines, andything like that which can be backed up with solid medical info that you didn't have it before the accident, but have it now, you may be able to get something.

but if you went to the hospital right after, and checked yourself out, with no problems - chances are you won't get anything for pain and suffering.

Make an example out of the drunk driver. Get a solid lawyer, sue the hell out of the person, and do whatever you can to get that person jail/prison time. In my opinion, the alcohol percentange level should be raised slightly, and then if a person drives while being legally drunk, you should go to prison for 10 years minimum (no exceptions)... then we'll see how many more asshole drunk drivers will be on the roads. Glad to hear you're alright, and please get this idiot off the road and into jail. Good luck.

my ride got fucked up recently, I was stationary at some lights and another car hit me from behind, travelling at approx 80-100k, my car was an absolute wreck, It got smashed in between the car behind and the one infront.. not pretty

it's been a few months since then, I got a new car since that one was written off, I lost a few $k though in the process - I'm still trying to work on a compensation case..

I had whiplash too.. took months to go away


Very fucked up situation, it's a huge amount of stress all because some idiot did some stupid shit..
