selling content: 2257 concerns
IN SHORT, i want to sell some very good hardcore amateur video content. i will give 1 of the 25 licenses i'm going to sell to someone who will serve as a responsible custodian of records for me.
THE DETAILS, if you care are: there 25 full videos with 22 different cuties. here is one video sample, my most recent and probably my very last video (shot 2 weeks ago): AVERY OUTDOORS i am getting out of porn for variety of reasons. i've never been a player, so this content hasn't had much exposure. i want to sell off the content. to keep things reasonable i want to sell it in bulk, meaning sell license to all 25 of the videos for one very reasonable price ($1250). and i want to cap sales at 25, meaning i'm only selling 25 licenses, so it won't get over-exposed. the legal documentation/paperwork is flawless. the simple reason i don't want my name on it is b/c i am getting out of porn and i don't want 25 porn sites to come up every time someone googles me over the next decade. i know any mention of 2257 makes everyone nervous and some hysterial. however, i'm not looking to do anything shady. i am looking for someone established, with an office, etc, who will take this seriously. probably best if the person is in the USA, or at least Canada. Not looking for someone in Karachi. obviously, if there ever was a real question about any of the legalities, it would be MY ass as the original producer. of course, there won't be any question or i wouldn't even be considering this. in exchange i would offer for free one of the licenses to all the videos and an excellent deal on the vhs/dvd/ppv rights to the content. i will also include two domain names. not a lot of traffic, but some. and also one already built pay site that works really well with the content (simple/basic, but it's a good amateur site). this arrangement would be legal under all but the most paranoid interpretations of the law and the d.o.j.'s implementation guidelines. for instance, the creation of an 'organization' allows for an individual other than the actual cameraman to serve as a c.o.r. also, i would be providing documentation to the 24 webmasters who purchase licenses. ideally they would just list themselves as the c.o.r. as 2ndary producers, which they should anyway. at least some would say they should. the stuff will be encoded by july, and i'd like to get it all sold so i have no porn to claim on my taxes for 2005. e-mail: [email protected] yahoo instant message: hg_media |
"so this content hasn't had much exposure. "

Just a word to the wise about the idea of letting someone else hold your 2257 info for you.

I might be wrong though. But should the AG or his delegees knock on your door, you can show the records or argue it out. He will ship you to the nearest police station where you will get your lawyer to argue for you. Let's hope the AG does not push it and insist you're responsible. Because establishing you are not has to be done in court and that's not free. You have rights and your lawyers will happily argue them for you, at about $300-500 an hour. Or you could just go to the filing cabinet and produce the documents. :) |
i disagree. i would create an organization, sell the content, and then i would quit the organization. however, the organization would continue to exist, and it would have a custodian and the records would be kept on file at a business address.

The situation is the decision on who is right or wrong will be decided by others not you. You will just pay a lawyer to argue your case. This guy seems very lax in business and the law, my advice is to give him a wide berth. |

Been shooting this stuff 27 years, lived with 2257 since it started. |

(2) As Charly pointed out, the records have to be kept at the producer's place of business. An organization created subsequent to the production couldn't really be the producer, could it? |
