the apple store wouldn't be sold out of ipods, they have them in the special deal sections and the store. unless you're talking about the mini ipod.

yeah you can get it online, when you're on the apple store online scroll down and on the left side near the bottom should be a red tag for the special deals section where you can get a better deal on one.

and as far as retail stores they were right compusa sells them and believe it or not so does target

Should be plenty in stock at the Apple Store retail outlets however, at least the Vegas one had some in stock just recently and was getting weekly deliveries.

you're in NY man there are small mac shops all over the place. i don't know if target sells the mini but they sell the regular one.

and compusa has an online inventory check that you can use to check out and then call to confirm.
