Generally , i think this part of the law applies to pictures that intend to portray minors. (i.e. closeup , bald pussy pics etc )

I do believe this was addressed when they struck down the laws regarding simulated cp.

2) don't use any terminology that implies underage

There is actually a set of criteria in law-enforcement that even if a girl is 18 and doesnt pass a certain set of 'visual tests' the person selling the porn can still be arrested.
