I think he went down for creating fake accounts, thus "defrauding" Earthlink. Doesn't sound like he's going to jail for being a spammer.

he didn't get the jailtime for spam, he got it for identity theft......

FYI: He was not convicted for spamming. He was convicted for identity fraud. Personally, I think the Government should put all the telephone and direct mail marketeers in jail first.

Yeah, the 'spam' angle is sensationalism, the civil suit and the jail time were for falsifying business records, fraud, etc.
