Should it be illegal to filter legal spam?
 
If the spam was done legally, should it be illegal for ISP's or email providers to filter them?

Individuals and ISP's can block anyone they want for any reason. The law is very clear on this.....

So can I open a isp and block all emails that jews or hispanics send to my clients? Discriminiation? Violation of freedom of speech? Sorta thin lines on what you block if you ask me..

You are right CDSmith but the problem is that some people sign up for legitimate newsletters. To some they are spam but to the people who sign up for them they are not. The problem comes when an ISP blocks all mail that looks like the newsletter, which is a formatted like a lot of spam, so the legitimate newsletter doesn't end up getting though to those that sign up.

That should be an easy to win legal case for someone.

a lot of legit mass emails are getting lost in spam filters.

imagine this.. US post office provides a service to filter your junk mail.. everyonce in a while they also take out the magazine you subscribed to, or a catalog you ordered, or a mail-in rebate you were expecting or even a letter from a friend!

i just ordered a harddisk online a few hours ago and the email containing my receipt ended up in my junk email folder.. i think they're crossing the line here.

I know one instance of this is Charly, his content confirmation emails do not go thru to aol email addresses I believe..

Thats bullshit that a customer does not get their purchase confirmation because the isp blocked certain words of phrases..

Okay, that brings the problem into more focus than before. In that regard yes, I agree.... the legitimate opt-in mailers do have a problem.... but I don't call those guys spammers in the first place. Opt-in and double opt-in, by definition is "wanted" so it falls outside the definition of spam, which by definition is "unsolicited" mail.... as in unwanted.

The legit mailing listers certainly do have a case.

I think what M_M is asking here is not about "spam" but about bulk emails sent when the surfer specifically requested the email.

My answer for spam is no, someone shouldn't be allowed to sue.

But when it comes to double opt in sign ups being filtered, I'd have to say yes because the surfer gave permission.

There already are email newsletters having problems because of this. When most people surfing for porn sign up for their daily pictures using a hotmail or yahoo address and that the list owner can't get the mail sent to these folks, he stands to lose on some serious cash in the long run. It's only a matter of time before the shit hits the fan. I sure would hate my mailman decide of what mail I'm allowed or not allowed to get. I'm a grown man dammit and can decide that myself. The same should go for my email. I can filter it myself.

It's not all bulk mail that's spam.

Ofcourse its not illegal to filter spam. However you could sue isp for blocking your legitimate email

I suggest starting with mom and pops isps and bullying them lol
