Jenna Jameson fights Acacia
ADULT STAR JENNA JAMESON JOINS FIGHT AGAINST ACACIA RESEARCH INTERNET PATENT CLAIMS
SCOTTSDALE, ARIZONA ? (May 6, 2004) ? The world?s best known adult actress, Jenna Jameson, has joined a coalition of Internet marketers in a legal challenge to Acacia Research, a California company that claims to have a patent on virtually all information streamed or downloaded over the Internet. ?I am joining the Free Streaming Coalition to fight the strong-arm tactics of Acacia, which effectively wants to put a tax on every single person using the Internet for video-on-demand services, Internet radio, pay-per-view movies, video news clips from sites like CNN.com, and even songs from iTunes or Amazon.com,? said Ms. Jameson, who is the actress Rolling Stone magazine says ?put the star in porn star.? Free Streaming Coalition, an adult Web industry group, is supporting the defendants in over a dozen lawsuits in federal district court in Southern California. In those lawsuits, the Internet companies are arguing that the systems they and most, if not all, other companies on the Internet use are not covered by Acacia?s patents and that those patents are invalid. ?Acacia is making a blatant attempt to target the adult industry in its effort to extract unwarranted fees for alleged infringement of its patents,? said Ms. Jameson. ?I don?t think people realize the implications of what Acacia is trying to do. If Acacia succeeds in intimidating adult site owners, they will move to mainstream sites and begin charging fees that will have to be passed on to everyone who uses the Internet.? Ms. Jameson said her marketing and production company, ClubJenna, Inc., which operates more than a dozen popular Websites for other adult performers, has become a party to the legal campaign that is being coordinated by Spike Goldberg, president of New Destiny Internet Group and its popular HomeGrownVideo.com site. ?We are glad to have Jenna be a part of this group because she?s a cultural icon who will help make people aware that everybody using the Internet is at risk,? said Mr. Goldberg. ?We cannot allow Acacia to bully our industry, and Jenna will be a big help in knocking them down.? Mr. Goldberg added that, ?Acacia wants a cut of virtually everything that moves on the Internet. If they get their way, everyone will pay the price for Acacia?s predatory practice, as Acacia?s ?tax? will ultimately be passed on to consumers. Acacia makes no secret of its plan?they have said publicly they just want to ?dip their beak? into adult revenues, but in reality they want to dip their beak into everyone's pocket, whether they use adult sites or not. While we respect the intellectual property of others, we cannot sit idle while Acacia abuses the patent system in this way. They want to make millions on patents that they say covers technology which was well known and in public use long before their patents were even filed.? The case is currently in the pre-trial stage, as attorneys for Acacia and 16 Internet and hotel delivery companies battle over what Acacia?s patents actually cover. |

I was talking to one of the licensees at a recent convention and he said signing up has hurt his business very badly.
It seems people avoiding those on the list of licensees is getting results. Their sales are hurting. How long they stay in business to give Acacia fuel to screw the rest of us is debateble. The sadthing is the list of quitters is bigger than the list of fighters. |

You would think that those that settled would want to help the defendants privately, but I heard a rumour that some webmasters feel that Acacia isn't pushing hard enough on their competition. Patents can be used as an anti-competitive measure. It is very conceivable that anyone who settled with Acacia, could be doing so for a BUSINESS DECISION to financially cripple their competitors. I'm sure some of those who did sign either did it as a cheaper way out than fighting while letting others do it for them or saw it as a means to reduce the competition.
