My qeustion is this...

How/where/when did you file and recieve a trademark on your name? I called a couple of weeks ago to the USPTO and they said trademarks are not issued on a personal name unless the name is a business entity and part of a corporate logo.

We are currently trying to resolve a similar issue (mainstream business) where the offending party is not only using our company/product/brand name, but also copying our sales practice. SO we have spent considerable time and money trying to get some kind of protection.

I would seriously like to know how you did it and where I can find the info.

edit - unless you mean you have a "copyright", not a trademark.

You can NOT copyright a name.....Only Trademark...and yes, it is the name I use for business, the name found on my tax returns and on my business license. Otherwise I couldn't accept checks or open a bank account in that name. Therefore, it did fall under a trademark and I did file for like $335.00 to trademark it.

THAT'S AWESOME! I've never had anything Trademarked before but I thought it costed A LOT more money than that. Maybe I'm thinking about Patents and not Trademarks.

OK, just spent another 2 hours on the phone with our attorney and the USPTO. Again, we are being told that you cannot do what you have claimed you did. Do you have a copy of any of the paperwork or do you remeber who you spoke with over in WA? Was there a particular form you used and if so did it have a number or ID on it we could use for reference? Most govt. forms have some kind of version number on them. Or, what year was this done in, maybe something has changed and there is another form that replaced the one you did.

Yes patents are a little more costly. When I had my machine shop we had a process to machine a product that we had to patent cost $5,000 plus another 2,500 to go through an attorney.

Just tried going through an online trademark company and got told the same thing, no way to do this. What's the secret Ivy???

Maybe you could do a search at USTPO.gov and find other performers who have successfully registered their names as trademarks and do what they did?

Jenna Jameson has a trademark on her name, as do Tiger Woods and Billy Joel.

I have spent several hours looking for the info and talked to the USPTO 3 times this week. Also consulted our attorney and a company that does this service for a fee. All I am asking is for a better lead than the one she gave me.

You can trademark anything for free.....

Just slap a (TM) on it and it's done.

But if you actually have a (R) -- registered trademark (like $330 or whatever) then it's on file with the USPTO and you have a lot more instant leverage against trademark violators.

How long ago did you file?

I'm sure you figured this out already, but Trademarking isn't an immediate process. You have to do a search to see how many trademarks are similar to yours, and what they're being used for (in our case, it was a bunch), and then you have to decide how you're going to trademark it (clothing, CDs, etc)... Our logo and name took a year to get trademarked, and then we had to copyright all of our cartoons (all of which were wearing the trademarked logo).

Right, many do, and if any of them posted and touted off on GFY that they had gone through the process, I would have already asked them. You came and announced to everyone that you did, that's why we are asking YOU, not them. I doubt very highly that Jenna or Tiger would return my e-mail asking them for advice...

And I have replied over and over that the link you provided was of no use for the process you are claiming you have been through. Have you read my replies? Look them over again, I'm sure I was very clear on my points. NO ONE at the USPTO, nor our attorneys, nor at least 2 online TM sefvices has told me that the TM you claim to have is possible, so I am very SIMPLY asking you how/when/where you did it.

If oyu can't provide that SIMPLE info, I don't believe you have a TM on your name. In fact, a couple of people here have even searched for ANY TM on your name and found no results.

All I was asking for was some more help other than... Follow this link... SOme of us have the same stake that you do in these kinds of sites. If we cannot work together and help each other out then slowly, one by one, each one of us may succomb to the things that this other webmaster tried to do to you.

And since you seem to be taking this quesiotn as a personal attack, let me save you some time.... Obviously you are in the contest, so I cannot truely and accurately tell you what I really think about your crap for participation and help on the board in this specific matter. 9 weeks to go though, I won't forget, no worries, take advantage of it while you can. :thumbsup

I followed the link as well, and nothing on that page struck me as having to do with what she was talking about, that's why I refined my questions to make it more simple to answer and point me in the right direction.

You need to read it...it tells all about what you need to submit as far as a logo...what you need to be able to show and prove...the differences between goods and services definitions...how to submit your application it really is all right there....Sorry you don't have the time to go through and read it. I spent 15 minutes there and got the basics. Guess when it becomes important enough you can spend the time to figure it out.
