PrivateIvy, a question for you.
My qeustion is this...
How/where/when did you file and recieve a trademark on your name? I called a couple of weeks ago to the USPTO and they said trademarks are not issued on a personal name unless the name is a business entity and part of a corporate logo. We are currently trying to resolve a similar issue (mainstream business) where the offending party is not only using our company/product/brand name, but also copying our sales practice. SO we have spent considerable time and money trying to get some kind of protection. I would seriously like to know how you did it and where I can find the info. edit - unless you mean you have a "copyright", not a trademark. |

You can NOT copyright a name.....Only Trademark...and yes, it is the name I use for business, the name found on my tax returns and on my business license. Otherwise I couldn't accept checks or open a bank account in that name. Therefore, it did fall under a trademark and I did file for like $335.00 to trademark it.

OK, just spent another 2 hours on the phone with our attorney and the USPTO. Again, we are being told that you cannot do what you have claimed you did. Do you have a copy of any of the paperwork or do you remeber who you spoke with over in WA? Was there a particular form you used and if so did it have a number or ID on it we could use for reference? Most govt. forms have some kind of version number on them. Or, what year was this done in, maybe something has changed and there is another form that replaced the one you did.

You can trademark anything for free..... Just slap a (TM) on it and it's done. But if you actually have a (R) -- registered trademark (like $330 or whatever) then it's on file with the USPTO and you have a lot more instant leverage against trademark violators. |

I'm sure you figured this out already, but Trademarking isn't an immediate process. You have to do a search to see how many trademarks are similar to yours, and what they're being used for (in our case, it was a bunch), and then you have to decide how you're going to trademark it (clothing, CDs, etc)... Our logo and name took a year to get trademarked, and then we had to copyright all of our cartoons (all of which were wearing the trademarked logo).
