He is using content on that gallery stolen from us. I shot that content for exclusive use within our paysite. It has not been released to anyone for use in any other place.

We have tried to contact him directly but it appears as though his whois info may be bogus - his phone number certainly doesn't connect to anything.

contact the hoster / server provider tell them what he did and about the dmca and everything will solve quickly.

Could you clarify:
Is he promoting YOUR site with content from your member's area, or is he promoting some other site with content from your member's area?

He is using our content to promote another site - our affiliates are by invitation only and he ain't one of them.
