depends on how you are doing it . . . if by telephone it will depend on the state.

if you are just carrying a tape recoder and doing it without their knowledge, I don't THINK it is illegal

In california, It is NOT illegal to record someones voice or video if it is in a public place.
It is illegal to record someones voice and then use it as evidence in a case, unless the person knows/and or agrees to a recording.

Certain cases involving federal crimes can be exempt.

The reason they use wires and taps is establish intent. Then they take the recordings to a judge who can issue a search warrent. Any evidence obtained in the search can be used as evidence.

They can also use their judgement to stop a crime in progress if a feed on a wire shows that it is active progress.
Then they use the recording to as evidence to show why they raided, But they still can't use it as evidence for prosecution of the perps.
