It's a bust! GALLERY SUBMITTING = 2257 NON-COMPLIANCE & WORSE??
 

I've wondered about this lately.....


You go to your favorite large TGP... no warning page.

Ok, fine.

Now you submit your galleries...

Some galleries I have seen have 2257, but most don't.

And (afaik) NO GALLERIES have a warning page stating age requirements. I mean they can't of course - it would be against submission rules or something and would ruin the flow of the TGP.


So check it out...

You have now knowingly submitted your (hardcore & uncensored?) galleries to be displayed on TGP's that makes no efffort to warn minors that pornographic material are ahead... AND there is no USC 2257 compliance statement/link on your actual galleries.

And then when they click through... where are you sending them? To the warning page? Whats the point? You already showed them hardcore teasers on a gallery BEFORE The warning.



Beware folks... the DOJ is out there, making a list & checking it twice... gonna find if your salad tossing skills are nice. :2 cents:



Here are a couple suggestions for the paranoid:


- Deal only with TGP's that have a warning page compatible with US laws, regardless of the country they are in (if they want your US business anyway).

- Use mod_rehahahahaha rules to only allow access to your main/root gallery folder from TGP's that are on your approved list (TGP's that have warning pages).

This will help prevent TGP spiders or Joe Whoever from linking to your galleries and putting them on their own TGP's that may not be compliant with your new (paranoid) policies.

You could pop up a nice message stating that you don't mind them linking to them, but they need to get on your approved list first.

You have seen the recent headlines that the DOJ & all have guys *right now* out there surfing porn and finding sites that are not compliant.

And for TGP operators that use picture thumbnails w/nudity or hardcore...

I wonder what the legalities are of this are?

I mean aren't you supposed to have 2257 statement on the page since you are publishing the image?

Somehow I doubt most (if any) TGP's are compliant there.


Man if DOJ starts to attack I think TGP's will be first to go...

...and then those true opt-in email lists and SEO/PPC will be worth a mint :]

It is important to remember that 2257 has not a single shred of importance to those outside the USA.

But a lot of TGP operators are in the US I think...

I put 2257 on every gallery.
As far as who is linking to it directly bypassing my warning page - I can't see how I can be held accountable for that.

I now have a warning page on my hardcore thumb tgp. Yes I am paranoid. :(

um, they already are worth several times what TGP traffic is worth, but yeah, this would give it another nice bump ;-)

Isn't 2257 info required for 'producers' of content, not for people that link to pages that have content on them?

I think a 2257 compliance notice and records of where the custodian of records is required for any qualifying image that you publish on your site.

If what you said were true, then nohahahaha who used Matrix content for example would have to display 2257 statements -- only matrix would have to display them since they were the producer.

So in terms of TGP's....

Text-only TGP's would probably be fine.... but I am talking about ones that use thumbnails that represent the galleries they link to.

I would also be curious to know the same on advertisers banners displayed on your site.

Well I mean there is a point to all this.....

Imagine going to a liquor store and outside on the hahahahahahas they have giant hardcore posters adveritsing the fact that they have porno magazines inside.

But when you go inside, they still have the magazines behind the child-protected rack and wrapped in plastic.

Doesn't make sense... I doubt it would to a jury either.

Regardless of the community or community standards.
