SleazyDream 04-05-2004 12:10 AM

now this sucks - comming home and canada customs seized my laptop computer so that one of their computer specialists can go through all the files.

I'm beyound shit scarded, not cause of any my content - no worries there - but because of spam. I hadn't emptied my email trash folder in a whille and I have no idea what's in there or if I'm liable for any of it - as customs people can be idiots when it comes to this kind of thing. Probally 10K plus spams in there.

BradM 04-05-2004 12:11 AM

You're kidding me Sleazy. Jesus christ.

Wow now that's fucking gay, they seized your computer to go through your files. I wouldn't be happy about having the porn on there in addition to anything else, they don't need ammo as is.

On-top 04-05-2004 12:12 AM

Damn.

That sucks.

media 04-05-2004 12:12 AM

Hope you get it back.. Prolly alot of stuff on there you would not like to lose....

AOJ Brian 04-05-2004 12:12 AM

Damn. :(

Was this just some random thing.. or did they have a reason?

smack 04-05-2004 12:14 AM

ridiculous. Sorry to hear about that. i don't think it should be any problem though. if American customs seized it, then i would be worried. :winkwink:

Dveron 04-05-2004 12:14 AM

What was the reasoning behind confiscating it? Hope you don't have any bondage related materials on there. I had some content seized a few years back and ever since every parcel sent to me gets intercepted and opened.

insanesurfer 04-05-2004 12:14 AM

Did they say how long it would take them? If they are going to have it for like 6 months I would be very upset.

tbabe 04-05-2004 12:16 AM

im a firm believer that you can find something incriminating on any computer if you look hard enough.

Good luck sleazy

psyko514 04-05-2004 12:16 AM

that's really fucked up.

i hope you don't get in shit for anything!

PostWhore 04-05-2004 12:19 AM

Holy shit, is this for real??

NoCarrier 04-05-2004 12:20 AM

Does anyone know of any record of obscenity charges or other type of criminal charges resulting a confiscated computer investigation in Canada?

Trax 04-05-2004 12:20 AM

WTF
i cannot believe that
do they have the rights to do that without any reason?

Mr. Mojo Risin 04-05-2004 12:20 AM

:(

Shoehorn! 04-05-2004 12:22 AM

Shit man, that sucks. Hope you get it back.

Not in this country..bondage is no-where near illegal AND they dont even intercept killer/molestor mail unless they are incarcerated.

And Good Luck Sleazy

BVF 04-05-2004 12:24 AM

Wow...that is FUCKED....

Makes one wonder if he was being watched all of this time.

Sarah_Jayne 04-05-2004 12:27 AM

wow, that was my nightmare senario when I went to vegas. Hopefully they will know what spam is but like you said officals can be kind of dumb about those kind of things.

Leaving Canada with your mobile gear

Canadian mobile office professionals need to complete an Identification of Articles Y38 form. This provides proof that you own the mobile gear listed and have not purchased it while traveling outside the country.

You will need to take your mobile gear to your local Customs office and complete the form with a Customs officer. The serial numbers of your mobile gear and descriptions will be listed. This form has no expiry and is free. You can add new items to it, provided you attend a Customs office, as Customs must see the new item.

The form is wallet-sized and you must carry it with you and present it to Canadian Customs when re-entering Canada.

Important Note:
If you make any changes or improvements to your mobile gear while outside Canada, it is no longer deemed to be the same piece of equipment and you must declare the new value of the item.

I didn't say it was illegal. Maybe things have changed recently but I had mild bondage content seized under Customs Memorandum D9-1-1.

Sexually explicit "books, printed paper, drawings, paintings, prints, photographs, movie film, phonograph records, videotapes, audiotapes and representations of any kind" are subject to tariff code 9956 as outlined in the updated (September, 1994) Revenue Canada, Customs Memorandum D9-1-1. These are to be screened and prohibited from entering the country if they meet the criteria for obscenity. If they fail to meet these criteria, they are to be allowed in, or withheld for review.

Now that that's set up, we can all review the details of the obscenity criteria. "...undue exploitation of sex...crime, horror, cruelty, and violence." We agree that those are a little vague, so we work out the details: "sex with...violence, submission, coercion, ridicule, degradation, exploitation or humiliation of any human being..." Bestiality (sex with animals) and necrophilia (sex with dead people) are not to be depicted or implied. Depictions of sexual assault or sexual activity that appear to be without consent or by force or deception are also out.

Bondage, servitude, external control in a sexual context, and depictions associating sexual gratification with pain or mutilation of any hahahaha part are sufficient for prohibition. Incest, pedophilia and murder in a sexual context had best be banned, and so should depictions of menstrual blood, fecal matter, and urine as part of sexual arousal

Should we start playing the dragnet theme yet? I would have put up a b*tch about it and make them bring a court order to confiscate it. You have that right I believe. And if they got the seixure order, I'd be on the phone every hour pestering them to hurry up before a suit needed filed over them holding up your legal business and the losses you are 'incurring'. lol

Strife 04-05-2004 12:37 AM

10k spam? damn..and I thought I had a lot :eek2

perfectodollars-gabrio 04-05-2004 12:38 AM

OMG, that's crazy!

Baal 04-05-2004 12:40 AM

Customs drones can be quite clueless. Good luck with that, Sleazy!

How clueless can they be? True story:
About 5 years ago I was flying from Canada to the states, returning home from Christmas. In my carry-on bag, I had a toaster oven someone gave to me. We're talking about a 9"x12"x14" toaster oven, not some mini-toaster thing... a full-sized toaster oven. A lady working for U.S. customs looked in my bag, shuffled a few things around, and then as she closed my bag she said "Don't worry, you don't have to turn on your computer." I had no computer; she was referring to the toaster oven!

So hopefully the Canadian customs agents won't try to jam a slice of bread into your laptop before they turn it on :1orglaugh

That's seriously fucked. Wonder if they'll go and undelete stuff too.

Time for a beer and a song.

Imagine there's no heaven,
It's easy if you try,
No hell below us,
Above us only sky,
Imagine all the people
Living for today...

Imagine there's no countries,
It isnt hard to do,
Nothing to kill or die for,
No religion too,
Imagine all the people
Living life in peace...

Imagine no possesions,
I wonder if you can,
No need for greed or hunger,
A brotherhood of man,
Imagine all the people
Sharing all the world...

You may say Im a dreamer,
But Im not the only one,
I hope some day you'll join us,
And the world will live as one.

Digipimp 04-05-2004 12:47 AM

You should have grabbed the laptop and ran back into the US and then throw yourself off a cliff with it.

Jdoughs 04-05-2004 12:49 AM

Dveron...i dont doubt at all they seized it and quite possibly went threw your belongings and even possibly served a search warrant for your residence.

I have a hard time seeing them open your future parcels and packages...It just doesnt seem right? Unless the content was illegal..which you stated it wasnt.

ps..hope i didnt sound like i was shit talkin .. i wasnt

DavePlays 04-05-2004 12:54 AM

Wonder if they'll bust a nut when they find out that they have the laptop of an "elite" webmaster.?

Validus 04-05-2004 12:59 AM

Well, Canadian Customs can honestly be difficult. I?ve never had as much troubles travelling into Canada as any other country, oh and I am Canadian. I would suggest, if the laptop is important to you, that you contact legal counsel.

Another question. If everything is password protected, would they try to crack it? Is it legal??

jaYMan 04-05-2004 01:04 AM

You'll probably get it back with BigBrother2 spyware installed on it.

Fuckers...

Well my stuff was intercepted via mail from US and I don't believe customs get involved with searching residences etc and it's not like I was trying to get CP or some shit sent in.

I guess your name and adddress goes onto some list and future parcels are checked for the same type of materials. Not involved in that niche any longer so no big deal really.

Do some shit talkin if you want :)

goBigtime 04-05-2004 01:12 AM

I typed all this...

Quote:

Wtf... can they even do that?

Doesn't that cost your business money?

I wonder what the legalities would be if you had some hardcore encryption on there.

Would they force you to unlock they drive for them?

What would they do if you told them you forgot the password and have it written down at home somewhere.

I thought Canada was supposed to be a good country?

But then I just decided to \/\/rite this instead...

Wtf Canada??

Canada Customs doesn't like pornography period.

WHo ever suggested just take it back and demand they get a court order .. That's nonsense and good luck with that. You have very few rights once you try to cross that border. You can't decide what they're going to keep for further inspections.

Buddy of mine came back from living in Costa Rica with a hard drive. Customs seized his harddrive in the same fashion they did your notebook. Later they sent him a letter saying they had confiscated it for Illegal Import and they were keeping it. No charges filed.

Just buy a new notebook and count your lucky stars that they didn't decide to strip search you too.
