Have program terms gone to far?

I just read throw the new, updated terms of one of my sponsors, and it's now forbidden to even mention there name, sites or url's without written consent and approval of the text including there name.

I may not link to them from an "obscene" web site.. (how am i to promote a porn site without using stuff that some people will find obscene?)

if i somehow spread a virus, intended or unintended, i will be dropped.

If a girl on my sites looks like she is under the age of 18, i will get dropped (no matter if i have proof of her age).

If a minor visits my web site i will get dropped.

They reserve the right to not pay for traffic they don't like, when they don't like it.

They reserve the right to change the terms at any time without any notice, and those changes are binding as soon as they got changed.

If they decide that i have broken any of this or the other 50 rules, my account will be terminated and all funds retained as liquidated damages. I will have no saying nor option to defend myself. there word is the law, and with all the extremely weak and 'we decides if it's okay or not' rules, im pretty much fucked if the want to screw me over...

I'm not a cheater, i've never cheated a sponsor and i've been in this biz for 5 years now.. I simply can't sign something like this.

How far can sponsors push there terms?! Don't they think we read it? that we just click 'OK'? that there are not a thousand other sponsors around?

or am i perhaps the only one who feels threatened by terms like this?

every program has bullshit loopholes and "outs" if they choose to want to fuck you out of your money, depends on who it is and what their reputation is

Some are just trying to cover their asses, some just want to fuck you up in the ass.

yes, you are right.

i want an adult sponsor that allows
- obscene sites (beast, fisting, what not)
- virus spreading,
- underage looking girls

and the audience should be mainly minors.

real funny, until they decide to drop you because of obscene sites (nude girls), virus spreading (you use IE and got infected throwh the latest bug), and young looking girls (well THEY think that your old granny looks a bit young)...

real funny....

forgot the last one:

and one of your sites was visited by a 20y wanker who lived in an area where you need to be 21 to view porn.

well, though luck, that was YOUR responsibility....

rules are to protect themselves legally and to avoid abuse.

nastyking 03-25-2004 05:42 PM

we've come a long way when an adult sponsor says nude girls are obscene ...

those do seem pretty strict.
which sponser is it?
one thing you must keep in mind though is that rules are often not taken to their extreme, im sure there is a bit of leeway and you wouldnt get dropped if a minor visited your site for example

Nat 03-25-2004 05:49 PM

oh, okay, i'm the only one who read the ToS of programs... oh well...
i'm dropping this program right now... been with them for 4 years, but i won't take shit like this.

if i tell you the name of the sponsor without written consent, all my funds will be retained and my account dropped. as soon as i get the next wire i can tell you though, because then i'm not an affiliate anymore..
