Just got a CD letter for amyfisher.com
 

I have been retained by Amy Fisher regarding your unauthorized use of her name as the url for a pornographic web site.

As you are aware, your use of the domain name, amyfisher.com, violates the rights of my client and the terms of your Service Agreement with your registrar, Domain Bank, Inc.

Ms. Fisher has exclusive rights to the mark, "Amy Fisher". You on the other hand have no rights or legitimate interest in respect of the subject domain name. You have registered and are using such domain name in bad faith in clear violation of the established policies of ICANN and Domain Bank, Inc.

In addition to the foregoing, your use of the subject domain name infringes Ms. Fisher's rights under Federal Trademark Law (the Lanham Act) and the laws of the State of New York.

To avoid the expense and necessity of having legal action taken against you, demand is hereby made that you immediately cease and desist using Ms. Fisher's name and contact this office to make arrangements for the immediate transfer of the disputed domain name to Ms. Fisher or her designee.

Needless to say, nothing contained or omitted herefrom shall be construed to waive or limit any right or remedy of Amy Fisher, all of which rights are expressly reserved by Amy Fisher.

I would immediately search out obituaries from around the world and find a recently deceased Amy Fisher. Then at the top of your page make a visible reference to this deceased person - "This page is dedicated to the late Amy Fisher of her town, her country - May You Rest In Peace"

Tell them to go fuck themselves. It's a fucking name. Or, just say one of the models on your page is Amy Fisher, and come up with a name for all the models and try to buy the domains for those names too, so you can say you do that for all your models. Just an idea. :2 cents:


Fight the power.

Weigh the monetary value to the risk. I can not stand over zealous ass hats like that but how much money are you actualy making off that domain?

Is it enough to be worth your time to and money to defend in the event they do take it a step further? If it is fight them. If its not let your pride go and let the assholes have it.

Of course you could just kill the domain and park it as a blank page and not hand it over to see what they would do but thats if you like to play games.
