When a sponsor won't pay.
What can you do legally when a sponsor won't pay?
I have one that owes me approx $8000 some of it since November.:ak47: I am running out of patience and they are running out of excuses. Whats the procedure in the US for chasing debts.Is there a court for this and am I best getting a lawyer to represent me? Thanks in advance . |

I'd prefer no drama as I have been trying to get this resolved civil like.
They are not real well known around GFY so probably there won't be much drama anyway but I was hoping someone has had some experience in pursuing legal action against sponsors. They seem to be very much avoiding me at the moment even though they had promised to have this resolved today. But I will definetly flame them big time if I get no satisfaction. |
Call them out, and watch them either slide off into the woodwork, never to be seen again, or scramble to hand over the money whilst making excuses about email and icq errors. :winkwink:

Whats the circumstances that surround this. If they terminated you, was it for fraud, spam, etc? Obviously the sponsors name would be best so we can help see if there's a history of them not paying but at least tell us the reasoning behind it they gave.

There is no fraud involved.They don't dispute that they owe me the money.They just keep coming up with lots of excuses. Such as accountant sick,accountant's fault.accountants inept,will lget it fixed up right away ,thankyou for your patience and so on and so on. The sponsor is Hardcoremoney and I have started a few threads over the last 6 months on their reluctance to pay. |

The process in the states is called small claims court.
You don't have to have a lawyer... which is good since a lawyer normally takes 33 - 50% off the top. You can get the paperwork from a clerk of court in the city you want to sue them. The court advises them of the suit... and if they don't show up to defend themselves, you win by default. The question is, what do you win. Simply a court decision. Thererfore it is better to do one of two three things... 1. Sue in his hometown... so the shit can be tried for what's called contempt of court if he does not abid by the courts decision in your favor. 2. If a lawyer is involved, they normally will be sure to get their money, so they will badger the shit to death if he doesn't pay... plus take him back to court. 3. Sell the debt to a debt collector... but you only get about 10 cents on the dollar. They breaks his legs if he doesn't pay... but you are not responsible. One other thing... since I assume you are not US... If you win or lose, you are responsible for your own legal fees in the US. Therefore, when you sue the shit, be sure to ask for your legal fees to be reimbursed... or you are shit out of luck. Hope this helps a little. Good luck. |

Since they're not disputing that they owe you the money, I would definitely go with a debt collection agency. First off, you should aggressively send them letters and invoices (3 notices should be enough). If they keep stalling like this, then sell the debt to a collection agency. Include the emails to prove they are aware of the debt and they should be willing to take it for you. But you should expect a good 20-30% fee be taken if they collect (they should only charge you if they're successful).
