Let's talk 2257

Who do I put as the custodian of records if it's all sets I purchased off content brokers? Do I have to fly my address up there or can I request that inquiries be e-mailed or telephoned?

the content broker should have supplied your with the name and address of the custodian of records when you purchased the content. Look at your licence for the images it should be there.

Best advice you will get here.

You see in different countries, States, etc. it is different. I would suggest you name the seller as the holder if you cannot name yourself. But [B[INSIST[/B] that you get the documents to check them.

I actually have an internet attorney but I haven't been in contact with him for years. Last time it was about underage girls too. (I was in high school and it was pics of me and my friends at school, parents were angered about the content of the rest of the site so they decided to hit me with that).

It's just an AVS site for now, but I'm planning on feeding it with gallery traffic so who knows who's lurking around those TGP's.

here's my :2 cents:

if i'm buying content -- which i don't -- i'd only buy content with copies of 2257 accompanied with dicss or scanned .doc/.pdf files of EVERYTHING...including ID's.

What if you're popped? And it's *your* site, and the officials want to see the models' proper ID's that appear on YOUR site, and you say "but, this guy's got them! here's his contact!"

And the government official shrugs his shoulders and says "it's not my problem to find him."

Then, let's say you go to find him...and you can't.

Fun, huh?

This is all a made-up scenario, but I don't think it's far-fetched.

One quick follow-up -- I spoke to someone who was asked for 2257 by govt. officials...and it was all done via US mails. They asked him model names they wanted, and he was told to send copies to Washington DC...

He's also very reliable, so I have no reason not to believe him.

I have a small question about 2257. Does one really need to have a section 2257 compliance page up on a site?

I was looking at Naughtyjenn.com http://www.naughtyjenn.com/ the other day and noticed that the link to the section 2257 compliance notice just directs to http://www.professorcash.com/

Are canadians exempt from having to list up the name and address of the custodian of records?

Mutt 03-19-2004 11:30 AM

that's probably better but the law doesn't require that you have model ID's on your premises - you are a secondary publisher, you are required to have a 2257 notice of the primary producer with compliant information according to 2257 requirements.

i like the people who buy content from countries they couldn't identify on a map and just take a leap of faith that the ID's are real. you stand a good chance of tracking down a model in the United States should you need to - good luck finding the girl in Khazikstan while the sherrif is going through your hard drives.

Paranoia

billywatson 03-19-2004 11:43 AM

I dunno Mutt -- where are you reading 2257, exactly? I've read it on Cornell's Law School site, and it doesn't mention that at all...

And paranoia, Calvinguy? Really...hmmm. With this administration? And severe punishments if you don't comply? You really want to risk it??

Let's hope it's just paranoia.

MasterBlogger 03-19-2004 11:47 AM

Having learned about 2257 compliance right here on GFY ... I'm going with the biggest most well known suppliers ... like Adult.com and Playboy.com.

"risk management" ...
