I'm not an attorney but it would depend on the community standards in the community you're sending the adult content to. So if it's SF and you send gay tapes you could send and not get sued but then again ...

why would you even push the envelope this way? This day and age don't take the risk, its simply not worth the consequences.

When I was in the 900 biz we would send out hardcore mags to people who called our 900 numbers (with more 900 number advertising, of course :winkwink: ). We never had a problem as long as we removed them when they requested it. We DID use a mail drop in San Francisco since it was considered more "porn friendly" and we supposedly had a prior relationship with the people we mailed to.

We had hundreds of complaints a month (Junior would call from granny's line, and granny would get the mail) but nothing was ever done if we removed upon request.

HOWEVER, your best bet is to ask your attorney. :thumbsup

It's legal to send requested information to some zip codes, and illegal to send requested information to others... don't know about unsolicited info, though.....

If you mailed one envelope inside the other, with the 'sensitive' content on the inside of the inner envelope with a damn good warning for minors and others that may not want to view adult material written on the outside of the inner envelope....

Then (maybe) opening the inner envelope would be 'opting in' to view your 'sensitive' content...
