is this legal or illegal? lots of sites do it...http://www.entensity.net does it and they get a lot of visitors.... they were even featured on cnn money week

Theres no such thing as public domain.

Perfectly legal. I get a lot of content off Yahoo that way.

In general this statement is absolutly untrue.

However in the case of celeb pictures it is unlikly that there are any PD pics. What makes a celeb site legal is the fair usage laws and the freedom of speech if you besides show pics do news reporting, movie reviews etc.

This goes for vidcaps only, Playboy images and other magazine scans would still be illegal.
